HomeMy WebLinkAboutResolution - 286 - A Resolution Confirming and Adopting the Assessment for Special Street Maintenance MTN-69-1 - 09/30/1969 EXTRACT OF MINUTES OF MEETING OF LiLLAGE COUNCIL OF EDEN PRAIRIE, MINNESOTA Pursuant to due call and notice thereof, a regular-special meeting of the Village Council of the Village of Eden Prairie was held on the _day of September_ ,19_q , commencing at 7:30 o'clock, P.M. , at the Village Nall , 8950 County Road #4, Eden Prairie, Minnesota. The following members were present: Mayor Osterholt, Councilmen , �edpath Lieb, Nesbitt, and Haugen The following members were absent : None Mr. i i Ph introduced the following resolution and moved its adoption: RESOLUTION NO. 286 A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR Sppcisal Street Maintenance MTN-69-1 WHEREAS, Pursuant to due and proper notice according to law an assessment hearing was held on the 30th day of September, 1969 relating to MTN-69-1 and, WHERAS, All persons present desiring to be heard were heard and their objections, if any, were noted N0W, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF EDEN PRAIRIE, MINNESOTA, AS FOLL0WS: 1. This Village Clerk has calculated the proper amounts to be specially assessed for Improvement MITN-69-1 against every assessable lot, piece:: or parcel of land, in accordance with the provisions of law, and has prepared and filed in this office tabul at6d statements in duplicate s'nowi ng the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same. 2. Notice has bcun duly published as required by law that this Council would meet in regular session at this time a rid place to pass on the proposed assessment. 3. The proposed assessment has at all times since its -filing been open to inspection and copying by all persons inter- ested , and an opportunity has been given to all intended persons to present their objections, if any, to such proposed assessment, or to any item thereof, and nQ objections have been filed. 4. This Council finds that each of the lots,pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the street maintenance in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. 5. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for: Improvement MTN-69-1 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of __per cent per annum. r -2- B. Such assessments shall bL payable in 1 equal amount installments payable on the 1 S T clay of January in each year, beginning* in thu year 19 , and continuing until all of said installments shall-have been paid, each installment to be collected with taxes collectable during sa i d year by the County ,`.udi tor. To the first installment shall be added interest on the: entire issessment from the date *.hereof to DecemGcr 31 , 19�g_. To each subsequent i nstal lmont shall b- added interest for ono year on all unpaid installments . 9.
