HomeMy WebLinkAboutResolution - 285 - A Resolution Confirming and Adopting the Assessment for Temporary Street Improvement STR-69-1 - 09/30/1969 EXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF EDEN PRAIRIE, MINNESOTA Pursuant to due call and notice thereof, a regular-special meeting of the Village Council of the Village of Eden Prairie was held on the 30t.Way of September 1969 , commencing at 7:30 o° clock, P.M. , at the Village Hall , 8950 County Road #4, Eden Prairie, Minnesota. The following members were present: Mayor OSterholt, Councilmen Redpath, Li eb, Nesbitt, and Haugen The following members were absent : None Mr. Redpath introduced the following resolution and moved its adoption: RESOLUTION NO. 285 A RESOLUTION CONFIRMING AND ADOPTItNG THE ASSESSMENT FOR 1EMPnRARY STREET IMP-RRY1VEMENT STE-62-1 WHEREAS, Pursuant to due and proper notice according to law an assessment hearing was held on the 30th day of September, 1969 relating to STR -69-1 and, WHERAS, All persons present desiring to be heard were heard and their objections, if any, were noted NOW, THEREFORE , BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF EDEN PRAIRIE, MINNESOTA, AS FOLLOWS: 1 . The Village Clerk has calculated the proper amounts to . m be specially assessed for Improvement STR-69-1 against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has prepared and filed in this office tabulatkc' statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same. 2. Notice has boon duly published as required by law that this Council would meet in regular session at this time and place: to pass on the proposed assessment. 3. The proposed assessment has at all times since. its filing been open to inspection and copying by all persons inte r- usted, and an opportunity has been given to all intended persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed. f. This Council finds that each of the lots,pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the street improvement in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. 5. Such proposed assessment is affirmed , adopted and confirmed, and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for: Improvement STR-69-1 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of per cent per annum. -2- 3. Such assessments shall bi: payable in 3 equal amount instal ln►ents payable on the E ST day of January in each ;roar, beginning' in the yuar 1970 and continuing until all of said installments shaiT'Tave bLen paid, each installment to be collected with taxes collectable during said year by the: County ;auditor. To the first installment shall be added interest on thu entire assessment from the data '>.hercof to Deccmbu•r 31 , 1969 To each subsequent installment shall b- added interest for one year on all unpaid installments . 9. Thc. Village Clerk is hc:rchv directed to make up and file in th,- offi cc of th,-: County '-.udi tors of Hcnnepi n County a certified statement of the amount of all of such unpaid assessments and the amount which ►gill due thereon on the 1st day of January in each year. The above motion was secondud by .1jr.
