A RESOLUTION CONFIRMING AND ADOPTING
THE ASSESSMENT FOR
COUNTY ROAD 18 SOUTH (WASHINGTCN AVENUE
SOUTH) IMPROVEMENT PROJECT.
WHEREAS, pursuant to due and proper notice according to law an assessment
hearing was held on the lst day of November, 1968, at eight o'clock p.m.
relating to County Road 18 South (Washington Avenue South) Improvement Project
and,
WHEREAS, all persons present desiring to be heard were heard and their
objections, if any, were noted
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF EDEN PRAIRIE, MINNESOTA, AS FOLLOWS:
"I . The Village Clerk has, with the assistance of t&& Rieke, Carroll & Buller
engineers heretofore selected by this Council for such purpose, calculated
the proper amounts to be specially assessed for Washington Avenue
against every assessable lot, piece or parcel of land, in accordance
with the provisions of law, and has prepared and filed in his office
tabulated statements in duplicate showing the proper description of
each and every lot, piece or parcel of land to be specially assessed
in the amount calculated against the same.
2. Notice has been duly published as required by law that this Council
would meet in regular session at this time and place to pass on the
proposed assessment.
3. The proposed assessment has at all times since its filing been open
to inspection and copying by all persons interested, and an opportunity
has been given to all intended persons to present their objections,
if any, to such proposed assessment, or to any i +-em thereof, and
no objections have been filed.
4. This Council finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessment was and is specialty benefited
by the construction of storm sewer mains, sanitary sewer mains, water
mains, installation of blacktop and concrete curb and gutter
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
5. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in his office and shalt thereupon be
and constitute the special assessment for County Road 18 South (Wash-
ington Avenue South) Improvement Project.

7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same have been paid at
the rate of six percent per annum.

8. Such assessments shall be payable in ten equal annual installments
payable on the 1st day of Janet in each year, beginning in
the year lg 69 , and continuing until all of said installments shall
have been pa each installment to be collected with taxes collectable
during said year by the County Auditor. To the first installment shall
be added interest on the entire assessment from the date hereof to
December 31 1968 To each subsequent installment shall be
added interest for one year on all unpaid installments.

9. The Village Clerk is hereby directed to make up and file in the
office of the County Auditor of Hennepin County a certified
statement of the amount of all of such unpaid assessments and
the amount which will be due thereon on the lst day of January
in each year.
ADOPTED by the Village Council of the Village of Eden Prairie at a
regular meeting thereof held this day of November, 1968.
