VILLAGE OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 226 A RESOLUTION APPROVING A LOT DIVISION FOR NICK SERIOS PROPERTY IN THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 12, TOWNSHIP 116, RANGE 22, HENNEPIN COUNTY, MINNESOTA. WHEREAS, Nick Serios has applied to the Village Council of the Village of Eden Prairie for approval of division of the hereinafter described property lying in the Northwest Quarter of the Northwest Quarter of Section 12, Township 116, Range 22, Hennepin County, Minnesota, the division to be legally described as follows: That part of the Northwest Quarter of the Northwest Quarter of Section 12, Town- ship 116, Range 22, described as follows: Commencing at a point on the South line of said subdivision at the intersection of said South line and the Westerly right-of-way line of U.S. Highway 169; thence Westerly along said South line 121 .49 feet which is the actual point of beginning of the land to be described; thence Northwesterly on a line deflecting to the right 77 degrees 03 minutes from the Westerly prolongation of the South line of said subdivision a distance of 340 feet; thence on a line deflecting to the left 108 degrees 38 minutes from the Northwesterly prolongation of the last described course a distance of 140 feet; thence on a line deflecting to the right 29 degrees 40 minutes from the Southwesterly prolongation of the last described course a distance of 159.5 feet to the West line of said Northwest quarter of the Northwest quarter; thence South along the said West tine a distance of 255.5 feet more or less to the Southwest corner thereof; thence Easterly along the South line of said subdivision 341 .35 feet to the point of beginning, which is a point 121 .49 feet West on said South line from the intersection of said South line and the Westerly right-of-way line of U.S. Highway 169. Except therefrom the following described property: That part of the North- west Quarter of the Northwest Quarter of Section 12, Township 116, Range 22, described as follows: Commencing at a point on the South line of said sub- division at the intersection of said South line and the Westerly right-of-way line of U.S. Highway 169; thence Westerly along said South line 121 .49 feet which is the actual point of beginning of the land to be described; thence Northwesterly do a line deflecting to the right 77 degrees 03 minutes from the Westerly prolongation of the South line of said subdivision a distance of 340 feet; thence on a line deflecting to the left 108 degrees 38 minutes from the Northwesterly prolongation of the last described course a distance of 140 feet; thence Southerly to a point on said South line 159.0 feet West of the actual point of beginning; thence East 159.0 feet to the point of beginning. Also that part of Lot 17 lying Westerly of a line drawn from a point on the North line distant 182.35 feet East of the Northwest corner of said Lot 17 to a point on the Southerly line distant 220.6 feet from the Southwest corner of said Lot 17, all in Willow Creek, Hennepin County, Minnesota. • i That part of the Northwest quarter of the Northwest quarter of Section 12, Township 116, Range 22, described as follows: Commencing at a point on the South line of said subdivision at the intersection of said South line and the Westerly right-of-way line of U.S. Highway 169; thence Westerly along said South line 121 .49 feet which is the actual point of beginning of the land to be described; thence Northwesterly on a line deflecting to the right 77 degrees 03 minutes from the Westerly prolongation of the South line of said subdivision a distance of 340 feet; thence on a line deflecting to the left 108 degrees 38 minutes from the Northwesterly prolongation of the last described course a distance of 140 feet; thence Southerly to a point on said South line 159.0 feet West of the actual point of beginning; thence East 159.0 feet to the point of beginning. Also that part of Lot 17 lying Easterly of a line drawn from a point on the North line distant 182.35 feet East of the Northwest corner of said Lot 17 to a point on the Southerly line distant 220.6 feet from the Southwest corner of said Lot 17, Willow Creek, Hennepin County, Minnesota. WHEREAS, the Village Council of the Village of Eden Prairie finds that said division of the above mentioned parcel does not interfere with the purpose and intent of the Ordinances of the Village of Eden Prairie, NOW, THEREFORE, BE IT RESOLVE© by the Village Council of the Village of Eden Prairie that a division of the aforementioned property as hereinbefore described be accepted and approved. W. of C.S.A.H. h to 0L3.. ._B. of.C.S...H._)I and WHEREAS said plans are on file in the office of the Department of Highways, Saint Paul, Minnesota, being marked, labeled, and identified as S.P. 7QJ.l.ly (T,H't =121) ; and WHEREAS said special provisions are on file in the office of the Department of Highways, Saint Paul, Minnesota, being marked, labeled, and identified ash p 270 .,11, (T3 rt,.321 , T which, together with the Minnesota Department of Highways Specifications for Highway Construction, dated January 1, 19 on file in the office of the Commissioner of Highways, constitute the specifications for said improvement of Trunk Highway Number 121 renumbered as Trunk Highway Number 5 ; and WHEREAS copies of said plans and special provisions as so marked, labeled and identified are also on file in the office of the Villave Clerk, and WHEREAS the term "said plans and special provisions" as herein- after used in the body of this resolution shall be deemed and intended to mean, refer to, and incorporate the plans and special provisions in the foregoing recitals particularly identified and described. Form 2523 (10-66) NOW, THEN, BE IT RESOLVED that said plans and special provisions for the improvement of Trunk Highway Number 121 renumbered as Trunk Highway Number 5 within the limits of the VMSn-of ' den Prai.ri* be and hereby are approved. BE IT FURTHER RESOLVED that the elevations and grades as shown in said plans and special provisions be and they are hereby approved and consent is hereby given to any and all changes in grade occasioned by the construction of said Trunk Highway Number 121 renumbered as Trunk Highway Number5in accordance with said plans and special provisions.
