PARAGRAPH 3.03 OF ARTICLE 3 OF THE JOINT
AGREErCNT DATED MARCH 29: 1968, ESTABLISYi-
ING THE SOUTH.4—EST SANITARY SEdER DISTRICT.
WHEREAS, the Village Council of the Village of Minnetonka
' entered into an agreement dated the 29th day of. March, 1968, with
the Villages of Deepbaven, Eden Prairie, Prior Lake and the Town �
of Eagle Creek, providing for the establishment of a Southwest
Sanitary Sewer District, and;
WHEREAS, it has been proposed by the Southwest Sanitary
Sewer District Board that the voting provisions as set forth in
,Paragraph 3 .03 of Article 3, of said agreement, be' amended, and;
WHEREAS, the ;Tillage Council of the Village of Minnetonka
f deems It reasonable and proper and in the public interest to so
amend Paragraph 3.03 of Article 3 of said agreement as proposed by
the Board;
NOW TH R]IFORE BE IT RESOLVES BY THE VILLAGE COUNCIL OF
THE VILLAGE OF MINNE`1'ONKA that Paragraph 3.03 of Article 3 of 6-he
agreement executed by and between the Villages of Leephaven, Eden
Prairie, Minnetonka, Prior Lake and the Town of Eagle Creek., dated
the 29th day of March, 1963, creating the Southwest 0'anitary Sewer
Diatri.et, be and hereb7y is amended upon the adoption of a like res-
olution by each of the said municipalitler •so as to read as follows.,
to wit:
3 .03 Haan member of the Board shall be entitled to one vote
for each 2,0040 ;population of the municipality appOinzing t3uch member,
except that no Board;,member shall have legs than one vote, nor shall
any Board member cast a total number of votes in excels of the sum of
the total number of votes cas-1 b� all the other members of the Board.
The population figure and 1?oting rights to be based on the most recent
official ,eneas. Thc- attf;ndance at any regular or special meeting of
the Board of those members holding a majority of the votes auth-
orized to be cast shall constitute a quorum. The Board shall elect
a chairman from its members, and a secretary and treasurer who may
or may not be members, and prescribe their duties, The Board shall
establish its own rubs of order.
