RESOLUTION 6491
A RESOLUTION RELATING TO TRUNK HIGIMAY 1r9WITHIN THE VILLAGE OF EDEff PRAIRIE.
At a (regular) (special) meeting of the Viliage COMWI of the _1►iI�
of Eden Prairie duly held on the 2 rd day of October , 196j, the follow-
ing Resolution was offered by nnjmr4,j1 n, R�,�_, ;

WHEREAS the 'PillM of 14M PIVAr a has approved
the plans and specifications for the improvement of that part of Trunk
Highway Number _5_ renumbered as Trunk Highway Number 3A9 within
the corporate limits of the 'Vim of Edm DMILIre from the
8.19_ id. S. Jot. T.H. 494 to 1..27 to at tw Jet. ?.L 3A9
id. E. Jet. T.H. 494
and
WHEREAS in order to obtain Federal Aid in the construction of
said Trunk Highway Number 5 renumbered as Trunk Highway Number 3A9_
the Bureau of Public Roads requires the assurance that the 1% 1m of
Mm Prairies will not suffer any encroachment of any nature or kind
whatsoever on the right of way of said Trunk Highway Number 5 renum-
bered as Trunk Highway Number 1+69 within the corporate limits of
the said V113 of I&M Pmtrie ; and
WHEREAS the Commissioner of Highways desires in the interest of
public safety that all parking of vehicles on said trunk highway be para-
llel with the curb and at least 20 feet from any crosswalk.
NOW, THEN, BE IT RESOLVED that said MlAge of Idm VrairU
does hereby agree and covenant that it will never permit or suffer, within
its corporate limits, any encroachment of any kind whatsoever, including
curb gas pumps and gas stations, billboards or other structures of any
kind whatsoever, upon the right of way of Trunk Highway Number_.j_renum-
bered as Trunk Highway Number 169 _ and to the above end said CLja&g&
of -px hereby agrees that it will never issue any license,
permit, or grant, or give any leave or liberty or any other consent of
whatever form for the construction or maintenance of any encroachment

whatsoever, including curb gas pumps and gas stations, billboards or
other structures of any kind whatsoever, upon said right of way; and that
said Y1. _ of MW P.�otirle will cooperate insofar as possible to
eliminate existing encroachments constituting traffic hazards and will
further take any necessary action to eliminate any encroachment that may
hereafter exist on said trunk highway right of way; and
BE IT FURTHER RESOLVED that said YMW of FASQ FrairU
does hereby agree to require the parking of all vehicles on said trunk
highway to be parallel with the curb and at least twenty (20) feet from
any crosswalks on all public streets intersecting said trunk highway
within the corporate limits of said YiII _ of Eden PMA&U
