A RESOLUTION DENYING A COMMUNITY WATER SYSTEM,
RESOLUTION NO. 87
WHEREAS, the Village Council of the Village of Eden Prairie did on the
25th day of February, 1964, adopt Ordinance No. 43 whlcb ordinance Is an ordinance
regulating the Installation, construction, alteration, extension, repair and
maintenance of wells, and
WHEREAS, the aforementioned ordinance by virtue of Section 22 permits
construction of community water systems under certain circumstances, and
WHEREAS, on the 9th day of ,tune, 1964, there was presented to the
Village Council of the Village of Eden Prairie a proposal by Wal--Don Builders for a
• community water system in a plat known as Topview Acres, and
WHEREAS, on the llth day of August, 1964, the firm of Rieke-tarroll &
Associates, inc., were retained by the Village as consulting engineers for the
purpose of reviewing and making such .recommendations of the plans of the proposed
water system for the plat of Topview Acres, as- they saw fit, and
WHEREAS, the firm of Rieke-Carroll& Associates, Inc., under the date of
August 26, 1964, did report on the proposed system to the Village Council, and
WHEREAS, the Village engineers stated that Installation of the system
would at best
1 . Aid the developers in selling of homes by virtue of public appeal
for community system as distinguished from individual wells,
2s Possibly reduce to}the developers the cost of providing water
1by the installation of a community water system as distinguished
from Individual wells, and

WHEREAS, the community would become Indirectly involved in the water
system operation because of
I . Problems involving operation and maintenance
2. Lack of effective municipal control over the system
3, Problems in integrating the private systems into a municipal
system when an over-gall plan for Village water supply has not been
made, and
WHEREAS, the consulting engineers have recommended that at this time
a private water system be denied, and
WHEREAS, all homes constructed In the Village of EdenPrairie can be
furnished an adequate and potable supply of water by private wells when said
wells are constructed in accordance with Ordinance No. 43 of the Village.
NOW THEREFORE, BE IT RESOLVED, that based on the findings of our
• engineers that the Village Council of the Village of Eden Prairie, deny the
request of Wal-Don Builders to build a privaL- water system in the plat of Topvlew
Acres until such time as themaster plan of the Village has been updated and a
master plan for a municipal water system made so that individual systems can be
incorporated within it.
ADOPTED by the council of theVlllage of EdenPrairie at a regular
meeting held this a 3 day of , 1964.
