HomeMy WebLinkAboutOrdinance - 24-97 - Amending City Code Sec. 4.06 & 4.80 - Beer, Wine & Liquor - 05/06/1997 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. c4- 97 AN ORDINANCE OF THE CITY OF EDEN PRAIRIE, MINNESOTA, AMENDING CITY CODE SECTION 4.06, SUBD. 3, RELATING TO THE DEFINITION OF PREMISES LICENSED UNDER A LIQUOR LICENSE;AND CITY CODE 4.80, SUBD.D,ADDRESSING THE EMPLOYMENT OF PERSONS WORKING IN A LICENSED ESTABLISHMENT WHO ARE UNDER 21 YEARS OF AGE; AND ADOPTING BY REFERENCE CITY CODE CHAPTER 1 AND SECTION 4.99 WHICH,AMONG OTHER THINGS,CONTAIN PENALTY PROVISIONS. THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, MINNESOTA, ORDAINS: Section 1. Section 4.06, Subd. 3 is amended to read as follows: Subd. 3. Premises Licensed. Unless expressly stated therein, a license issued under the provisions of this Chapter shall be valid only in the compact and contiguous building or structure situated on the premises described in the license; and all transactions related to a sale under such license must take place within such building or structure, except that in the case of a restaurant licensed for on sale alcoholic beverages and located on a golf course, "licensed premises" means the entire golf course except for areas where motor vehicles are regularly parked or operated. Section 2. Section 4.80, Subd. D of the City Code is amended to read as follows: Subd. D. A person under the age of 21 years to enter an establishment licensed under this Chapter for the purpose of purchasing or having served or delivered any alcoholic beverage. Persons under 21 years may enter establishments licensed under this Chapter in order to: consume meals; attend social functions that are held in a portion of the establishment where liquor is sold; and perform work for the establishment, except that persons under 18 years are prohibited from selling or serving any alcoholic beverage. Section 3. City Code Chapter 1 entitled "General Provisions and Definitions Applicable to the Entire City Code Including Penalty for Violations" and Section 4.99 entitled "Violation a Misdemeanor" are hereby adopted in their entirety, by reference, as though repeated verbatim herein. Section 4. This ordinance shall become effective from and after its passage and publication.
