HENNEPIN COUNTY, MINNESOTA
ORDINANCE NO. 4-93
AN ORDINANCE AMENDING SECTION 4.05, SUBD. 5, OF THE CITY CODE WHICH
RELATES TO DELINQUENT TAXES AND CHARGES IN CONNECTION WITH THE
GRANTING OF BEER, WINE, AND LIQUOR LICENSES.
THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, HENNEPIN COUNTY,
MINNESOTA, ORDAINS:
Section 1. City Code Section 4.05, Subd. 5, is hereby amended
to read as follows:
"SECTION 4.05. STANDARDS.
Subd. 5. Delinquent Taxes and Charges. No license under
this Chapter shall be granted for operation on any
premises upon which taxes, assessments, or installments
thereof are owed by the applicant and are delinquent and
unpaid, except those delinquent and unpaid taxes,
assessments, or installments thereof
(a) which are the subject of an agreement between
the taxpayer and the Hennepin County Treasurer
that provides for the payment of the
delinquent and unpaid taxes, assessments, or
installments, together with any penalty and
interest thereon in twelve (12) equal monthly
payments commencing on or before the date the
license is granted, and further provides that
any unpaid amount, together with any
additional penalty and interest will be paid
on or before the date of the payment of the
last installment, and
the licensee shall have entered into an
agreement with the City that in the event the
taxpayer has not complied with the terms of
the agreement with the Hennepin County
Treasurer, such noncompliance shall be
sufficient grounds to suspend or revoke the
license.
For the purpose of this Section, "applicant" includes
persons and related persons owning, directly or
indirectly, (1 ) at least a fifty percent (50%) beneficial
interest in the proposed licensee or in an entity owning
such interest in the proposed licensee or in the entity
making the application and (2) at least an undivided one-
half interest in the premises proposed to be licensed or
at least a fifty percent (50%) beneficial interest in the
entity owning such premises.
Section 2. City Code Chapter 1 entitled "General Provisions
and Definitions Applicable to the Entire City Code Including
Penalty for Violation" and Section 4.99, entitled "Violation a
Misdemeanor" are hereby adopted in their entirety, by reference, as
though repeated verbatim herein.
Section 3 . This Ordinance shall become effective from and
after its passage and publication.
FIRST READ at a meeting of the City Council of the City of
Eden Prairie on the 5th day of January, 1993 , and finally read and
adopted and ordered published at a meeting of the City Council of
said City on the 19th day of January, 1993 .

Summary: This ordinance amends the City Code with respect to issuance of liquor licenses
in connection with tax delinquent businesses.
Effective Date: This Ordinance shall take effect upon publication.
