HomeMy WebLinkAboutOrdinance - 28-90 - Cedar Ridge 2nd Rural to R1-13.5 - 08/21/1990 Cedar Ridge 2nd Addition CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA ORDINANCE 28-90 AN ORDINANCE OF THE CITY OF EDEN PRAIRIE, MINNESOTA, REMOVING CERTAIN LAND FROM ONE ZONING DISTRICT AND PLACING IT IN ANOTHER, AMENDING THE LEGAL DESCRIPTIONS OF LAND IN EACH DISTRICT, AND ADOPTING BY REFERENCE CITY CODE CHAPTER 1 AND SECTION 11.99 WHICH, AMONG OTHER THINGS, CONTAIN PENALTY PROVISIONS THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, MINNESOTA, ORDAINS: SECTION 1. That the land which is the subject of this Ordinance (hereinafter, the "land") is legally described in Exhibit A attached hereto and made a part hereof. SECTION 2. That action was duly initiated proposing that the land be removed from the Rural District and be placed in the R1-13.5 District. SECTION 3. That the proposal is hereby adopted and the land shall be, and hereby is removed from the Rural District and shall be included hereafter in the R1-13.5 District, and the legal descriptions of land in each District referred to in City Code Section 11.03, Subdivision 1, Subparagraph B, shall be, and are amended accordingly. SECTION 4. City Code Chapter 1, entitled"General Provisions and Definitions Applicable to the Entire City Code Including Penalty for Violation" and Section 11.99, "Violation a Misdemeanor" are hereby adopted in their entirety, by reference, as though repeated verbatim herein. SECTION 5. The land shall be subject to the terms and conditions of that certain Developer's Agreement dated as of July 2, 1991, entered into between , a , and the City of Eden Prairie (hereinafter "Developer's Agreement") and that certain supplement to the Developer's Agreement, dated as of July 2, 1991, 1991, entered into between , a , and the City of Eden Prairie (hereinafter "Supplement"). SECTION 6. This Ordinance shall become effective from and after its passage and publication. FIRST READ at a regular meeting of the City Council of the City of Eden Prairie on the day of , 1991, and finally read and adopted and ordered published at a regular meeting of the City Council of said City on the 2nd day of July, 1991. EXHIBIT A That part of the West half of the Northwest Quarter of the Southeast Quarter lying North of the centerline of County Road No. 1, EXCEPTING therefrom that part described as beginning at the intersection of the centerline of County Road No. 1 and the West line of said Southeast Quarter; thence northerly, along said West line, a distance of 165.00 feet; thence easterly, at right angles to said West line, a distance of 165.00 feet; thence southerly, at right angles, to the centerline of said County Road No. 1; thence southwesterly, along said centerline, to the point of beginning. That part of th-e West half of the Southwest Quarter of the Northeast Quarter lying South of the North 1152.27 feet. That part of the East 403:40 feet of the Southeast Quarter of the Northwest Quarter lying South of the North 1152.49 feet, EXCEPT the West 40.00 feet thereof. That part of the East 403.40 feet of the Northeast Quarter of the Southwest Quarter lying North of the centerline of County Road No. 1, EXCEPT the West 40.00 feet thereof. That part of the West half of the Northwest Quarter of the Southeast Quarter of Section 20, Township 116 North, Range 22 West, Hennepin County, Minnesota. lying North of the centerline of County Road No. 1 described as beginning at the intersection of the centerline of County Road No. 1 and the West tine of said Southeast Quarter; thence northerly, along said West line, a distance of 165.00 feet; thence easterly, at right Angles to said West line, a distance of 165.00 feet; thence • southerly, at right angles, to the centerline of said County Road No. 1; thence southwesterly, along said centerline, to the point of beginning. f - - - Cedar Ridge 2nd Addition CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 28-90 AN ORDINANCE OF THE CITY OF EDEN PRAIRIE, MDU F.SOTA, REMOVING CERTAIN LAND FROM ONE ZONING DISTRICT AND PLACING IT IN ANOTHER, AMENDING THE LEGAL DESCRIPTION OF LAND IN EACH DISTRICT, AND ADOPTING BY REFERENCE CITY CODE CHAPTER 1 AND SECTION 11.9, WHICH, AMONG OTHER THINGS, CONTAIN PENALTY PROVISIONS. THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, MINNESOTA, ORDAINS: Summary: This Ordinance allows rezoning of land located north of County Road 1 and west of Cedar Ridge Estates at Rogers Road, from the Rural District to the R1-13.5 District, subject to the terms and conditions of a developer's agreement.
