HomeMy WebLinkAboutOrdinance - 25-89 - Amending Code 11.03, Subdivision 6A – Land Use Regulations - 07/18/1989 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 25 -89 AN ORDINANCE OF THE CITY OF EDEN PRAIRIE, MINNESOTA, AMENDING CITY CODE CHAPTER 11 ENTITLED "LAND USE REGULATIONS (ZONING)" BY AMENDING SECTION 11.03 , SUBD. 6 . A. AND ADOPTING BY REFERENCE CITY CODE CHAPTER 1 AND SECTION 11 .99, WHICH, AMONG OTHER THINGS, CONTAINS PENALTY PROVISIONS. THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, MINNESOTA ORDAINS: Section 1. City Code Section 11.03 , Subd. 6. A. is amended to read as follows: Subd. 6. Site Plan and Architectural Design Review. A. Approval Required. No building permit shall be issued for the construction of any ( i) building or structure situated or to be constructed within any District, except, (a) those within the Rural District or One-Family Residential Districts, and (b) duplexes (dwellings designed for or occupied by two families) , or ( ii ) building or structure constituting a public facility and service, situated or to be constructed within any District, including but not limited to Rural and One-Family Residential Districts, unless it shall conform to a Site Plan and Architectural Design as described in C. hereof, or an amendment thereof, which has been approved by the Council and such approval is effective as hereinafter provided. -1- No building permit shall be issued for the construction of an alteration or enlargement of a ( i) building or structure situated within any District, except, (a) those within the Rural District or One-Family Residential Districts, and (b) duplexes (dwellings designed for or occupied by two families) , or (ii) building or structure constituting a public facility and service, including but not limited to Rural and One-Family Residential Districts, unless it shall conform to a Site Plan and Architectural Design as described in C. hereof, or an amendment thereof, which has been approved by the Council and such approval is effective as hereinafter provided. The approval of a Site Plan and Architectural Design shall be effective for a period of two years from the date first approved by the Council, provided however, the Council may within the two year period (or any extension thereof as hereinafter pro- vided) extend the two year period for an additional period or periods of two years each. Section 2. City Code Chapter 1 entitled "General Provisions and Definitions Applicable to the Entire City Code Including Penalty for Violation" and Section 11.99 entitled "Violation a Misdemeanor" are hereby adopted in their entirety, by reference, as though repeated verbatim herein. Section 3.
