HomeMy WebLinkAboutOrdinance - 43-87 - Amending Chapter 9.04 RE: Alcohol, Air Mattresses, and Glass Containers on Public Beaches - 08/18/1987 ORDINANCE NO. 43-87 AN ORDINANCE OF THE CITY OF EDEN PRAIRIE, MINNESOTA, AMENDING CITY CODE SECTION 9 .04, RULES AND REGULATIONS GOVERNING PUBLIC PARKS, BY AMENDING SUBD. 4.Q TO PROHIBIT ALCOHOLIC BEVERAGES ON PUBLIC BEACHES; BY AMENDING SUBD.4.V TO PERMIT AIR MATTRESSES IN DESIGNATED AREAS; AMENDING SUBD. 4.Z TO PROHIBIT GLASS CONTAINERS ON PUBLIC BEACHES, AND BY ADDING NEW SUBD. 4.ZA REGULATING MOORING AND DOCKING OF BOATS. THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, MINNESOTA, ORDAINS: Section 1 . City Code Chapter 9, shall be amended by amending Section 9 .04, Subd. 4.Q. to read as follows: Q. Serve, possess, or consume liquor, except beer or wine (included in this exception is beer which contains in excess of 3 .2 percent of alcohol by weight) ; [to] possess a beer keg or serve or consume beer from a beer keg, unless a permit has been obtained therefore from the City; [to] serve, possess or con- sume beer or wine (including beer which contains in excess of 3 .2 percent of alcohol by weight) in that part of Round Lake Park situated north of Valley View Road and in the Flying Cloud Athletic Field, unless a permit has been obtained therefore from the City [ ; or to serve, possess, or consume any alcoholic beverage in any public beach area; ] Section 2. City Code Chapter 9 shall be and is amended by amending Section 9 .04, Subd. 4.V to read as follows: V. Use air mattresses, inner tubes, or other inflated—arti- cles or flotation equipment in any park lakes, except that [air mattress may be used in areas specifically marked and designated by the City for air mattresses. This subdivision shall not apply to] inflatable boats used on park lakes pursuant to [a] Minnesota State Water Craft License or Permit; Page -2- Section 3 . City Code Chapter 9 shall be and is amended by amending Section 9 .04, Subd. 4.Z to read as follows: Z. [Possess glass containers in public beach areas; or to] deposit, scatter, drop or abandon bottles, cans, glass, coals, ashes, sewage, waste or other material [on park property] , except in receptacles provided for such purpose. Section 4. City Code Chapter 9 shall be amended by adding new Section 9 .04, Subd. 4.ZA to read as follows: ZA. Moor or dock any boat to public docks, rafts, buoys or ropes which are part of a designated swimming area. Section 5.
