• BOARD OF APPEALS AND ADJUSTMENTS
THURSDAY, AUGUST 11 , 1983 7:30 PM, CITY HALL
BOARD OF APPEALS MEMBERS: Chairman Ron Krueger, Richard Lynch,
James Dickey, Roger Sandvick, and
Hanley Anderson
BOARD STAFF: Jean Johnson, Zoning Administrator,
and Lynda Diede, Recording Secretary
ROLL CALL: Dickey and Sandvick were absent. Anderson arrived at 8:00 PM.
I. Minutes of July 14, 1983.
Lynch moved, seconded by Anderson, to approve the minutes of July 14,
1983. Motion carried unanimously.
II. VARIANCES
A. Request#83-24, submitted by Nordquist Sign Company Inc. , for
property located at Lot 1 , Block 15 Edenvale 4th Addition, east
of Mitchell Road & Valley View Road intersection. The request
is for a variance from City Code;Chapter 11 , Sec. 11 .70, Subd.
49 A. , 2, to install an area identification sign 44 square feet
in Size for the Edenyale Apartment site.
Scott Bader, Edenvale Development, showed plans of the proposed
sign. He introduced Randy Nordquist, of Nordquist Sign Company
Inc. They are proposing one 44 square foot sign on Valley View
and Mitchell Road, as opposed to two 24 square foot signs. The
sign will be 41x10' with an 8"x5' vacancy sign hanging below.
It will be constructed of wood timbers.
Krueger inquired if the original plan was for two signs. Bader
replied that one large sign would have more impact than two
smaller ones.
Lynch asked if the sign would be illuminated. Bader replied, no.
Lynch questioned if the vacancy attachment sign would be made of
wood. Bader said yes, it will be a two sided brown sign with
ivory fetters.
Lynch asked if the sign would be exposed to Mitchell Road. Bader
responded, yes.
There were no comments from the audience.
MOTION: Anderson made a motion to approve Variance Request
#83-24, submitted by Nordquist Sign Company Inc.
• with the following finding: One large sign is

being substituted for two smaller signs. Lynch
seconded the motion. Motion carried unanimously.
• They have one year to exercise the petition.
B. Request #83-25, submitted by Ryan Construction Company, for property
located on City West Parkway. The request is for a variance from
City Code, Chapter 11 , Section 11 .03, Subd. 3, K, to permit con-
struction of an office building with 46% cedar siding on the
exterior."
Jerry Junkman, Project Manager of Ryan Construction, presented
his request to the Board. The project will be a two story,
20,000 square foot office building, for one tenant, located on
City West Parkway and Shady Oak Road. They are asking for a
variance to allow more than 25% use of cedar siding. Plans
were displayed of the project. The design concept for the
building is burnished block, glass and cedar, to make it com-
patible with the surrounding area. Junkman introduced Al
Shackman, Vice President of Ryan Construction Company.
Lynch asked what the fundamental construction rraterial for the
building would be. Junkman replied that it will be a structural
steel building.
Krueger inquired if the cedar would be stained. Junkman replied,
yes.
Lynch asked what the normal maintenance of the exterior of the
building would be. Junkman replied that it would be stained the
first and second years and every five years thereafter.
Lynch remarked that the City aims at controlling maintainable
exteriors. After a period of time, what would happen if it
were left natural. Junkman said that it would fade; it would
need a seal '
Lynch commented that the cedar would be an improvement over
burnished block if it were properly maintained.
There were no comments from the audience.
MOTION: Lynch made a motion to approve Variance Request
#83-25, submitted by Ryan Construction Company
Inc. , with the following finding: The owners
must maintain it in a respectable manner. Krueger
seconded the motion. Motion carried unanimously.
They have one year to exercise the petition.
C. Request #83-26, submitted by Mr. & Mrs. Jerry Rodberg, for
property located at 6517 Rowland Road. The request is for
a variance from City Code, Chapter ll , Section 11 .03, Subd.
2, to permit platting of a 10 acre tract into two 5 acre tracts.
The proposed west 5 acre tract will be considered for a house
moving permit and will be addressed 65ll Rowland Road._

Ed Sieber, Ed Sieber & Associates, real estate agent representing
Jerry Rodberg, outlined the plan to the Board. In 1982, Hennepin
• County acquired Rodberg's property for park purposes. Rodberg
would like to divide an existing 10+ acre site into two 5 acre
lots and place his home on the lot.
Hakon Torjesen, 6605 Rowland Road, stated that he had no objection
to the action.
Roger and Gail Farber, 6525 Rowland Road, remarked that they also
had no objections.
Lynch commented that he was troubled by the preliminary plat of
property, that it was not well thought out considering the grades.
Sieber felt that it was drawn up to show how some type of future
development would fit in.
Lynch asked when water and sewer would be put in on Shady Oak Road.
Johnson replied that if property owners want water and sewer, and
petition for it, it would be a two or three year process for
feasibility and installation work.
Torjesen added that this transitional zone is in an area where
ultimate utility extension has not really been designated.
Lynch pointed out that Rodberg's plan doesn't address any non-
conforming uses; there is a lack of detail. Information related
to the home occupation is desired.
Lynch wondered if moving the house would be a practical venture.
Sieber agreed that the cost was great. Lynch noted that the(!
house would have to be brought up to code.
Lynch remarked that the land division is not a real problem. The
problem is the moving of the house and potential platting of the
property. The house moving has not been touched on, regarding
landscaping, placement of the home, the bonding issue or bringing
it up to code.
Lynch inquired if the building inspector had inspected the home.
Johnson replied yes, the plumbing and residential inspectors
found that some improvement was needed to meet code, but not a
substantial amount.
Lynch felt that the best interests for Rodberg would be to continue
the request until next month so that Rodberg could respond to
questions from the Board members.
Sieber stated that he felt Rodberg was asking for a subdivision and
general permission to move, and would get approval at a later date.
Lynch asked if the existing home would be rented. Sieber expressed
• doubt that it would be.

MOTION: Lynch made a motion to continue Variance Request
#83-26, submitted by Mr. & Mrs. Jerry Rodberg,
• until September 8, 1983. Anderson seconded the
motion. Motion carried unanimously.
D. Request #83-27, submitted by Baton Corporation, for property
located at the southwest corner of Franlo Road & Co. Rd. 1 .
The request is for a variance from City Code, Chapter 11 ,
Section 11 .03, Subd. 2. ,- to permit construction of under-
round garages within 18 feet of the front yard along Co. Rd.
#1 30 feet required) and within 8 feet of the side yards
10 feet required) .
Due to the absence of the applicant, this variance request has
been continued until the September 8, 1983 meeting.
MOTION: Lynch made a motion to continue Variance Request
#83-27, submitted by Baton Corporation, until
the September 8, 1983 meeting. Anderson seconded
the motion. Motion carried unanimously.
