MINUTES
BOARD OF APPEALS AND ADJUSTMENTS
Thursday, May 15, 1975 City Hall , 7:30 p.m.
MEMBERS PRESENT: Don Sorensen, James Cardinal , James Wedlund, Tom Cebulla
MEMBERS ABSENT: William Bye
STAFF PRESENT: Wayne Sanders
I. APPROVAL OF MINUTES OF APRIL 17, 1975.
Mr. Sorensen moved to approve the minutes as published. Mr. Cebulla
seconded the motion. All voted aye.
II. APPROVAL OF MINUTES OF MAY 9, 1975.
Mr. Cardinal moved to approve the minutes as published with one
exception: Page 1, Para 2 from the bottom, the word "land" should be
"lane". Mr. Sorensen abstained due to absence. Mr. Cebulla seconded
the motion. Mr. Cardinal , Mr. Wedlund and Mr. Cebulla voted aye.
• III. Variance permitting setback into sideyard of approximately 10' for chain
link fence and dog run. Location - 6574 Flying Cloud Drive.
Mr. Sanders stated that Mr. Brill was asking for a 10' variance and 7 1/2
to 8' fence within._20 foot sideyard setback. It should be noted that the
inside fence should be squared off. Mr. Brill presented a letter from
the owner of the property to the east of his stating approval of the
, request.
Mr. Sorensen requested that the minutes state he would not vote or
participate in deliberations as Mr. Brill is his client.
Mr. Brill stated that from the outer fence to the runway it is 512". Also
the runs are removable cages.
Mr. Sorensen asked a point of information as to whether a removable cage
was considered a fixture or a structure. Mr. Sanders stated that.he would
consider it a structure because it is attached to the building and part of
usable space.
There was some discussion as to whether or not people moving outside of
the fence would cause the dogs to bark. It was stated that the outer
chain fence is 8' high. There was also discussion as to whether the
dogs would be able to climb the fence. Mr. Brill stated that it would be
impossible for a small dog to climb such a tall fence. The larger dogs
would not try to climb it but would try to jump over it only if they
had been trained to jump fences.

Mr. Sorensen inquired whether board members were aware of the nature
and design of adjacent land use, especially the mini-storage structure
which would abut the proposed fence area.
Mr. Wedlund questioned if the traffic coming and going from the mini-
storages would distrub the dogs.
Mr. Brill stated a berm, which is a mound of dirt, has been built up
about 6' high behind the kennel. He plans on planting pine trees, bushes
and shrubs to block the view of the kennel from highway 169/212.
Mr. Cardinal moved that the Board of Zoning Appeals and Adjustments hereby
grants a variance in the sideyard setback requirements of Ordinance #135
in accordance with the plans dated 4/22/75 with full length runs on the
Bruce Brill property located on Flying Cloud Drive provided that the ex-
terior fence around the kennel dog run area be between 7 1/2 to 8' in
heights throughout and be of wood construction, from the present building
along the side fronting on Flying Cloud Drive and along the Northeasterly
side to a length sufficient to remove the possibility of visual observance
from Flying Cloud Drive and from normal pedrestrian movements on the adjacent
Minnesota Mini-Storage property. Said determination of visual observance
to be made by the City Building Department giving consideration to the
structure, topography and plantings on the said adjacent Mini-Storage
• property.
Mr. Cebulla seconded the motion. Mr. Sorensen abstained. Mr. Wedlund,
Mr. Cardinal and Mr. Cebulla voted aye.
IV. Field variance of minimum setback requirements.
Con't to next meeting pending discussion with staff set for May 28.
