EDEN PRAIRIE BOARD OF APPEALS AND ADJUSTMENTS
Thursday, May 9, 1975 7:30 p.m. City Hall

I. SWEARING IN OF NEW BOARD MEMBER JAMES CARDINAL.
II. APPROVAL OF MINUTES OF APRIL 17, 1975.
Continued to the meeting of May 15, 1975.
III. MINNESOTA TREE, INC. , variance to place double faced sign.
Mr. Sanders briefly discussed the variance. He stated that the
property was zoned as rural but was being used as commercial . He
also went over the requirements of the sign ordinance which allows
a sign to be no bi:gger than 80 square feet on each face.
Mr. Walt Carpenter briefly went over the history of his property. He
• also stated that his old sign is so far back from the highway and is
so small that it cannot be seen from T.H. Highway 5 coming from the east
or the west. Mr. Carpenter explained the problems with the zoning re-
quirements and that his property line starts 250' back from the right of
way on T.H. Highway 5.
Mr. Sanders pointed out that our ordinance does not allow signs in rural
zoning. Mr. Wedlund brought out the fact that T.H. Highway 5 would be
improving in the next couple years and how would his sign be effected
by this.
Mr. Carpenter stated that as of yet he had heard of no such improvements
from the Highway Department regarding T.H. Highway 5.
Mr. Wedlund also brought out the fact of whether Mr. Carpenter would be
inside or outside the Ring Road. Mr. Carpenter stated that when the
Ring Road came through he did not want to be a part of it.
Mr. Cardinal questioned if the sign would look like two signs instead of
one. Mr. Wedlund also questioned if the sign would cause confussion
because it will be placed right at the curve on T.H. Highway 5.
Mr. Carpenter stated that the sign would be placed so it wouldn't be
seen til you were on the four lane part of T.H. Highway 5.
Mr. Cebulla stated that according to the sign ordinance, double faced
signs shall be placed back to back with no more than 12 inches between
faces.

There was some di-scussion of the lighting of the sign, it was decided
that lighting would be up to Mr. Sanders. Mr. Sanders discussed the
qualifications of taking out a sign permit. It was decided that Mr.
Carpenter would not have to renew it til January of 1976 and yearly
thereafter. The permit would be reviewed by Mr. Sanders in January
of 1977.
A motion was made by Mr. Cebulla that the variance regarding a double
face sign, each side 80 feet in area and the sign would be constructed
as submitted by Mr. Carpenter from Minnesota Tree, Inc. The sign would
be according to plan also submitted with application for variance and
placement and location of sign to be reviewed at the time of the annual
granting of sign permit. The motion was seconded by Mr. Cardinal . All
voted aye.
IV. Mr. Robert J. Cutshall , variance permitting a 40' setback in lieu of
50' . Location 12780 Vina Road.
Mr. Sanders briefly went over the variance in which Mr. Cutshall was
requesting. He stated that 12770 Vina Lane is 40' from the cul-de-sac
and 12781 Vina Lane is 60' from cul-de-sac. Mr. Cebulla questioned if
12770 Vina Lane had requested a variance since the side lots were not
in keeping with the zoning ordinance. Mr. Sanders said variances were
• not always requested.
Mr. Cutshall stated his two reasons for asking for the variance; 1 . It
would be economical since it would cost him more to fill in if he had
to build 10' further back and it also would be better for the foundation,
2. He would have to cut down quite a few trees which would leave his
property with very few trees.
Mr. Sanders stated the elevation of his house would be 1 112' above the
street according to the survey. Since the City regulations state that
it must be 2' , he will have to get an O.K. from the Engineering Department.
Mr. Cardinal made a motion that the variance permitting a 40' setback in
lieu of 50' be granted. Mr. Cebulla seconded the motion. All voted aye.
Meeting was adjourned at 9:30 p.m.
