EDEN PRAIRIE BOARD OF APPEALS AND ADJUSTMENTS

I. Ordinance No. 135, Section 2.7 (4) , metal buildings.
Mr. Sanders introduced Messrs. Larry Degner of Airlift, Inc. ;
Paul Swanson of Metro Machines; Stanley Riegert of Prairie
Lawn and Garden Store. Mr. Ralph Nesbitt was also present
to help interpret the Ordinance which was passed while he
was serving on the City Council.
• Mr. Sanders stated he sent letters to Messrs. George Hite,
Ralph Nesbitt and Donald Brauer requesting their help in
trying to arrive at the Council' s original intention for
Section 2..7 (4) of Ordinance No. 135 and also to submit
answers in writing to the following three questions:
1. Was it intended in Section 2.7 (4) of Ordinance
No. 135 to approve wood pole buildings with a
metal skin as long as they are painted?
2. Was it intended in Section 2.7 (4) of Ordinance
No. 135 to approve metal framed buildings and
attach to this frame an independent metal panel
as long as it was painted?
3 . Was it the intention of Section 2.7 (4) of
Ordinance No. 135 to allow any building as long
as it was not galvanized metal or plain cement
block?
The Board reviewed the letters received from Messrs. Hite,
Nesbitt and Brauer.
Sanders - only hang-up he has is in regard to designing the
structure in conjunction with other buildings.

Cebulla - in view of the letters received from Messrs. Hite,
Nesbitt and Brauer and my interpretation of Ordinance No. 1359
Section 2.7 (4) 9 you (City staff) should be able to make decision
yourselves. Do these buildings or do they not meet the Building
Code?
Wedlund - would have to agree with Tom. It is up to Building Dept. ,
subject to all things meeting the Ordinance.
Sanders - are you referring to wood pole buildings as well as
painted buildings?
Cebulla and Wedlund - yes.
Nesbitt - sees many buildings like this now - basically for agricul-
ture and storage. Ordinance should have stated things more clearly.
Wedlund - how far are we going to go? Are we going to be happy
with this interpretation? Have to look at permanency of structure.
What length of time before they start looking shabby?
Degner - buildings are painted with epoxy paint and rust is not
a factor. They have 20-year guarantee. Hasa building which is
• ten years old and sound as can be. MAC favors this type of a
building for aircraft hangers. Some of these buildings are so
attractive in design, you cannot tell they are metal buildings.
Swanson - we want to use a building like this for storage. (He
showed Board members pictures of some new styles for metal buildings. )
Cardinal - wouldn't care to live in community where everyone built
those kinds of buildings. Think Ordinance No. 135, Section 2.7 (4)
should be reviewed in light of what has been discussed.
Wedlund - maybe we should have a recommendation from this Board to
the City Council to review the matter and make a decision. At this
time, the decision is up the Building Inspector. Going to the
Council is not an immediate solution.
Cebulla - obscure nature of Ordinance in dealing with buildings
of this type and can these buildings be considered adequately
under wording of Ordinance as it presently exists.
Riegert - do you realise what I have been through? This has been
going on for sixteen months. Want to start building soon.
Wedlund - this will not affect you. If your building meets the
Building Code, it is then up to the Building Inspector to issue
• you a Building Permit. We are discussing having the City Council
review the matter.

Sanders - The City Manager, City Attorney and I don't know what
is meant by the Ordinance.
Wedlund - don't wish to see long-term situations such as an indus-
trail park coming in and building buildings like these.
Swanson - other communities have coped with this problem, perhaps
we can do the same. The Ordinance should be looked at so that it
does not appear to be so nebulous. These buildings look very nice
with decorative stone and so forth.
Board members discussed the various kinds of metal buildings, uses,
costs, etc.
Cebulla moved that it is the finding of this Board, upon reviewing
Zoning Ordinance No. 135, Section 2.7 (4) , that there is some
obscurity in interpreting this Section, particularly, with regard
to buildings with painted metal skins of either wood pole or
metal frame construction. Therefore, it is the recommendation
of this Board that the City Council and Planning Commission review
this Ordinance commensurate with modern techniques and construction
regarding this type of building. In the meantime, this Board so
moves that the intent and wording of Ordinance No. 135, Section 2.7 (4)
should be interpreted and ruled on by the City Building Official in
• granting permits for construction. Cardinal seconded. Cardinal,
Cebulla and Chairman Wedlund voted "aye", motion carried unanimously.
Cebulla moved to adjourn, Cardinal seconded. Cardinal, Cebulla and
Chairman Wedlund voted "aye", motion carried unanimously.
