I. APPROVAL OF MINUTES OF JULY 17, 1975
Mr. Sorensen moved to approve the minutes of July 17, 1975 meeting as
published. Mr. Cardinal seconded, the motion carried.
II. Variance Request by Richard W. Gran, 9640 Franlo Road, permitting five foot
side lot variance and 3 foot street side variance for a 22 x 22 foot earaize.
Chairman Wedlund asked Mr. Gran to state his wishes.
Mr. Gran explained that his bouse was bought one and a half years ago. At
that time, there was 30 ft. between side of lot and house in approximate
location of where Bonner-Waters thought garage should go. He added, a 22 foot
• garage was set, but he was not aware of 10 foot side yard requirement, and
when it came to making plans for building of the garage this summer he discovered
it. Mr. Gran continued that he eliminated other places for this garage, and for
reasons following; this would be the best place for a garage without interfering
with views from windows, slope of land on two sides of the house, and as a
result came to Board of Appeals with this request.
Mr. Wedlund asked for letters of opposition or of recommendation for approval
by neighbors.
Mr. Gran responded that he approached Mr. Flaherty, one of the owners of
Bonner-Waters lst Addition, asking him to write Mr. Sanders of his approval.
He added, at that time, it was felt that location was the only logical place
for a garage on that particular lot.
Mr. Wedlund, referring to Staff letter of August 25, first para., inquired
whether in houses facing Franlow Road, would it incorporate the lot to the right.
Mr. Gran responded that 4.16 acres were incorporated, which were developed into
seven lots.
Board members discussed alternate positions for the garage including moving
garage just behind the house and overlapping the back of the house by just a
few feet.
Mr. Cardinal suggested attaching garage to the house just behind the kitchen
door, eliminating the 5 foot problem.

Mr. Sanders explained that under the Ordinance, garages are 10 foot and
houses are 15 foot from the side yard lot line.
Mr. Sorensen added that the reason for the front yard setback is to prevent
building in front of someone's view, and the visual aesthetics are what we
are concerned with here.
The front yard views of houses along circle was discussed. Mrs. Gran felt
they would front out to the golf course.
Mr. Wedlund asked whether there was a decision pertaining as to what was
front and side yard.
Mr. Sanders responded according to the Ordinance, the front yard is on the
street.
Mr. Sorensen added that there was a court decision, with interpretation based
on existing land use.
Mr. Sorensen asked whether Mr. Gran had objections to attaching the garage,
and what those objections were.
Mr. Gran responded he had two objections: 1. Cost factor for extra footings
2. Driveway taking up major part of that side of the house.
• Mrs. Gran added third objection-it would completely block out golf course view
from that whole side of the house.
MOTION
Mr. Cardinal moved to deny petition, because it is an extreme variance, there
are no neighbors to approve or disapprove, and it would set a precedent.
Mr. Sorensen seconded the motion.
DISCUSSION
Wedlund and Cardinal agreed with motion that it was too extreme of a variance,
and would be unfair to potential buyers next door.
Mr. Sorensen suggested looking at ordinance authorization and felt a literal
interpretation would not deny them the use of their property as they see fit,
and would permit them to achieve their goals without violating codes and
ordinance.
Mr. Cebulla added his opinion that he did not want to vote "no" because of
sympathy for the Grans and also because he did not feel it would block any view
because the cul-de-sac was round. He added that the point was well taken that
the houses would be built facing golf course.
Mr. Wedlund suggested bringing it back to original idea, curvature of house
and garage would blend with curvature of cul-de-sac, with a 2 foot variance only.
He asked how the Grans would feel about a delay and suggested they consult with
Mr. Sanders for help with their problems.
MOTION
Mr. C:ebulla moved to continue this matter for a period of 2 weeks, or a period
in which the Grans would have time to study the matter. Sorensen seconded the
motion and it carried unanimously.

Mr. Wedlund informed members he would contact them for next meeting.
Mr. Cebulla moved to adjourn at 9:10 PM. Cardinal seconded and the motion
carried.
