ORDINANCE NO. 279

AN ORDINANCE AUTHORIZING THE SEALING OF DEFECTIVE,
UNSAFE, OR UNLICENSED FOOD AND DRINK VENDING MACHINES,
OR WHICH BEING LICENSED DO NOT HAVE A TAG OR OTHER
LICENSE INSIGNIA AFFIXED, AMENDING SECTION 48 OF
ORDINANCE #250.
THE COUNCIL OF THE CITY OF, EDEN PRAIRIE ORDAINS AS FOLLOWS:
Section 1 . That Section 48 of Ordinance #250 adopted March 26, 1974

is hereby amended by adding thereto subdivisions e. and f. reading as follows :
e. Sealing of Unlicensed, Defective, or Unsafe Machines or
Devices and Affixing License Insignia. Any food or drink
vending machine, which is defective or unsafe or which is
licensed and has no license tag or other license insignia
affixed as required by law, or is required to be licensed
by the City of Eden Prairie and such machine or device is
not currently licensed by the City, may be sealed by a tape
or wire to prevent its continued use. The tape or tag
attached to the seal shall state that the machine or devise
is not to be used.
f. Removing Seal , Using Machine Prohibited. No person shall
remove or deface a seal affixed under the provisions of
this ordinance except under the direction of an authorized
agent of the City. No person shall use any machine or de-
vice on which a seal has been affixed under the provisions
of this ordinance.
Section 2. Penalty. Any person violating the provisions of this
ordinance shall be guilty of a misdemeanor and upon conviction shall be
punished by a fine of not more than three hundred dollars ($300.00) or by

imprisonment for not to exceed 90 days or both.

Section 3. This ordinance shall take effect fifteen (15) days
after its publication.
FIRST READ at a regular meeting of the Council of the City of Eden
Prairie this 3rd day of December, 1974, and finally read and adopted
and ordered published at a regular meeting of the Council of said City
on the loth day of December, 1974.

English language in newspaper format and in column and sheet form equivalent in printed space
to at least 900 square inches. (2) Said newspaper Is a weekly and is distributed at least once

subscriptions and maintained by the managing officer or persons in its employ and subject to his
direction and control during all such regular business hours and devoted exclusively during such

of the newspaper and business related thereto. (6) Said newspaper files a copy of each issue
immediately with the State Historical Society. (7) Said newspaper has complied with all forego-
