ORDINANCE NO. 270
AN ORDINANCE AMENDING ORDINANCE NO . 13.5 AND PROVIDING
FOR FIELD VARIANCES OF MINIMUM SETBACK REQUIREMENTS FOR
DETACHED SINGLE FAMILY RESIDENTIAL DWELLING UNITS BY THE
CHIEF BUILDING INSPECTOR

The City Council of the City of Eden Prairie does ordain as follows:

Section 1 : Section 2 of Ordinance No. 135 is hereby amended by adding
the following:
On his determination that one or more of the following criteria is met, 'J
a field variance may be authorized by the Chief Building Inspector to deviate
from the described side yards , rear lot line, front setback and setbacks
relating to corner lots:
1 . The variance will protect significant natural features such as
major trees or shrubs.
2 . The site is influenced by unbuildable soils , bedrocks or wetlands, or
slopes of greater than 20% making such a variance necessary.
3 . Significant vistas or views which would not otherwise be possible under
strict enforcement of setback requirements.
Section 2: Under no circumstances shall a field variance be granted by
the Chief Building Inspector which reduces the minimum setback to less than half
of the distance which would otherwise bLe required by Ordinance 135 .
Section 3 . The Chief Building Inspector shall prepare a brief report outlining
the reasons for any field variance which he grants under the authority of
this ordinance , and submit said report on a monthly basis to the Board of
Appeals and Adjustments for its review.
Section 4 . In the event the Chief Building Inspector should deny an applica-
tion for variance under this ordinance, such applicant may appeal such denial
to the Board of Appeals and Adjustments.
Section 5. Prior to the granting of any such field variance, the Chief
Building Inspector shall advise all affected abutting property owners by
written notice of such application for variance. The applicant may obtain signatures
of all abutting property owners stating their agreement with the applicants

proposed setback/variance, thereby eliminating the requirement for written
notice by the Chief Building Inspector, In the event said affected abutting property
owner,( owners ), should object to the granting of the application for variance , then
such application for variance shall be automatically forwarded to the Board of
Appeals and Adjustments by the Chief Building Inspector for its action.
First read at the regular meeting,of the City Council of the City of Eden
Prairie on this day of , 1974, and finally read, adopted and
ordered published at a regular meeting of the City Council of said City on the
day of 1974 .
