HomeMy WebLinkAboutOrdinance - 257 - Regulating the Use of Highways - 04/23/1974 ORDINANCE NO. 257 AN ORDINANCE REGULATING THE USE OF HIGHWAYS WITHIN THE CITY OF EDEN PRAIRIE, INCORPORATING PROVISIONS OF THE STATE HIGHWAY REGULATION ACT BY REFERENCE, AND IMPOSING A PENALTY FOR THE VIOLATION THEREOF. The Council of the City of Eden Prairie does ordain as follows : SECTION I. HIGHWAY TRAFFIC REGULATION ACT INCORPORATED BY REFERENCE. There is hereby adopted as a traffic ordinance regulating the use of highways, streets and alleys within the City of Eden Prairie, the following statutes of the State of Minnesota, as heretofore amended and now in force and effect , three copies of which are marked as official copies and filed i for use and examination by the public in the office of the City Clerk. All of Chapter 169 of Minnesota Revised Statutes , known as S { the "HIGHWAY TRAFFIC REGULATION ACT" , except the following sections thereof; 169.06, Subdivisions 1, 2 and 3; 169.09, Subdivision 9 ; 169. 10, 169. 11, 169 . 66; 169. 77; 169. 78 ; i 169. 83 , Subdivision 6 ; 169. 87; 169 _ 965; 169. 966. SECTION II. TOWING. Any police officer is hereby to be removed and towed away empowered to cause Y and to be stored, any unattended vehicle standing or marked in violation of the terms of this Ordinance or other lawful authority. Where such vehicle is towed away and stored , such vehicle will not be returned to the owner thereof except upon satisfactory proof of ownership and upon payment of the reasonable cost for towage and storage of such vehicle. { ; t 'x F vp SECTION III. APPLICATION TO PRIVATE PROPERTY. All provisions t of this ordinance applicable to pedestrians of the drivers of vehicles or bicycles upon the streets , highways or sidewalks of the City shall apply except where clearly inapplicable, to pedestrians and drivers of behicles and bicycles on private roads and driveways of the City, including school properties and off-street parking y areas . The City Manager may from time to time establish the maximum speeds at which behicles and bicycles may be driven in such off-street parking areas and upon request by the school board upon school board properties . Speed limits may vary from parking area to parking area and shall be based upon the requirements of safety in the areas affected . Each such speed limit shall be ( established in writing filed with the City Clerk and shall become effective as an absolute speed limit on being sigh.}-posted on such streets and upon such private roads and driveways and at each entrance to the parking area affected thereby, and no person shall drive a vehicle or bicycle at a speed in excess thereof. SECTION IV. PENALTIES . Any violation of the statute adopted by reference in Section I is a violation of this ordinance r when it occurs within the City of Eden Prairie. Any persons thus violating any provisions of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine of not to exceed $300. 00, or imprisonment in jail for a period not to exceed 90 days ; but if a minimum fine or imprisonment is prescribed by the State Highway Traffic Act for any offense, such penalties shall apply to a person convicted of the same offense under this ordinance. (2) Said newspaper is a weekly and is distributed at least ' once each week. (3) Said newspaper has 50% of Its news columns devoted to news of local § interest to the community which �t purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said , newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total � circulation currently paid or no more than three months in arrears and has entry as second- l class matter in its local post-office. (5) Said newspaper purports to serve the Village of Eden Prairie in Hennepin County and it has its known office of issue in the City of Bloomingtcn in Hennepin County, established and open during its regular business hours for tiie gathering of news, sale of advertisements and sale of subscription and maintained by the managing officer or persons In its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such business hours to the business of the newsppper and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historial Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication " 3 .with below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1968 and each January 1 thereafter an affidavit in the form prescribed by the 1 Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper. ?
