ORDINANCE NO. 249
CITY OF EDEN PRAIRIE
AN ORDINANCE FORBIDDING CERTAIN ACTS OF DISORDERLY CONDUCT.
THE COUNCIL OF THE CITY OF EDEN PRAIRIE ORDAINS AS FOLLOWS :
Section 1. The doing of any of the following acts without author-
ity of law by any person or persons is hereby declared to be disorderly
conduct.
a. Wilfully disturbing any assembly or meeting not unlawful in its
character, or the peace and quiet of any family or neighborhood.
b. Wilfully and lewdly exposing his person or the private parts
thereof, or procuring another to so expose himself, and any
open and gross lewdness or lascivious behavior, or any act of
public indecency.
C. Using profane, vulgar or indecent language in or about any
public building, store or place of business, or upon any of
the streets, alleys or sidewalks of the City so as to be
audible and offensive.
d. Voluntarily entering the water of any lake or public swimming
pool within the limits of the City without being garbed in a
bathing suit sufficient to cover his person and equal to the
standards generally adopted and accepted by the public.
e. Looking, peering, peeping into, or loitering around or within
the view of any window with the intent of interfering with the
rights or privacy of another.
f. Shoplifting, stealing or taking from the possession of the true
owner, or of any other person, with the intent to deprive the
true owner of his property, or of the use and benefit thereof,
or appropriate the same to the use of the taker, or of any other
person, money, personal property, chose in action, evidence of
debt or contract, or article of value of any kind when such pro-
perty is of a value of less than $100.00.
g. Lurking, lounging, loitering, or being concealed in, upon, or
near the public streets, highways, roads, alleys, parks, play-
grounds, sidewalks or other public places, public grounds, and
public buildings, places of amusement, entertainment or refresh-
ment, vacant lots, parking lots, or other unsupervised places
or any property, whether public or private, not his own;
(1) when such conduct results in the making of any noise, riot,
disturbance or improper diversion, to the annoyance or
disturbance of another, or
(2) when such conduct tends reasonably to or is likely to arouse F
alarm, anger, fear or resentment in another, or

(3) when such conduct is with intent to do any mischief or to
commit any crime or unlawful act, or
(4) when such persons shall collect in groups or crowds in,
upon or near any street, sidewalk or public place in said #
City so as to obstruct public travel or movement thereof.
Section 2. Penalty. The performance of any act forbidden, or failure a

f to perform any act required by this ordinance shall be a misdeameanor, which
upon conviction shall be punishable by imprisonment for not more than ninety

(90) days, or by a fine of not more than $300.00.

FIRST READ at a regular meeting of the Council of the City of Eden
Prairie this 25th day of February , 1974, and finally read and adopted and
ordered published at a regular meeting of the Council of said City on the
12th day of March , 1974.

space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least ,
once ea:h week. (3) Said newspaper has 501,.), of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
publication and is not made up entirely of patents, plate matter and advertisements. (4) Said
newspaper is circulated in and near the municipality which it purports to serve. has at least 11!
500 copies regularly delivered to paying subscribers, has an average of at least 7517, of its total `c
circulation currently paid or no more than three months in arrears and has entry as second-
class matter in its local post-office. (5) Said newspaper purports to serve the Village of
Eden Prairie in Hennepin County and it has Its known office of issue in the City of
Bloomingtcrt in Hennepin County, established and open during its regular business hours for
the gathering of news, sale of advertisements and sale of subscription and maintained by the t
managing officer or persons in its employ and subject to his direction and control during all i
such regular business hours and devoted exclusively during such business hours to the d I
business of the newsppaer and business related thereto. (6) Said newspaper files a copy of
each issue immediately with the State Historial Society. (7) Said newspaper has complied
with all the foregoing conditions for at least two years preceding the day or dates of publication 1
'rientioned below. (6) Said newspaper has filed with the Secretary of State of Minnesota prior
to January 1. 1966 and each January 1 thereafter an affidavit in the form prescribed by the
Secretaryof State and si ec, b the publisher of said newspaper and sworn to before a notary a
