ORDINANCE NO . 245 AN ORDINANCE RELATING TO CONDUCT ON SCHOOL GROUNDS a The Council of the Village of Eden Prairie does ordain as follows: Section I . Defacement of Scnool Buildings . No person shall mark with ink, paint, chalk or other substance, or post hand bills on, or in any other manner deface or injure any school building or structure used or usable for school purposes within the Village , or mark , deface , or injure fences, trees , lawns, or fixtures appurtenant to or located on the site of such buildings, or post hand bills on such fences , trees or fixtures, or place a sign anywhere on any such site. Section 2 . Breach of Peace on School Grounds . No person shall willfully or maliciously make or assist in making on any school grounds adjacent to any school building or structure any noise, disturbance or improper diversion or activity by which peace, quiet and good order shall be disturbed. Section 3 . Offensive Language and Conduct. No person shall use offensive,obscene, or abusive language or engage in boisterous or noisy conduct tending reasonably to arouse alarm, anger or resentment in others on any school grounds or in buildings or structures. Section 4 . Improper Conduct While School in Session. No person shall, in any t school room or in any building or on the grounds adjacent to the same, disturb or interrupt the peace and good order of such school while in session. No person not in immediate attendance in such school and being in such building or upon the premises belonging thereto shall conduct or behave himself or herself improperly. No person , upon the request of a teacher of such school or the person in charge thereof, to leave said building or premises , shall neglect or refuse so to do . Section 5 . Loitering . No person shall loiter on any school grounds or in any school building or structure. Section 6 . Penalty Provision . That any person violating any provision of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine of not more than $300. 00 or by imprisonment for not longer than 90 days or both. First read at a regular meeting of the Council of the Village of Eden Prairie this 26th day of December, 1973 , and finally read, adopted and ordered published at a regular meeting of the Council of said Village on the 8th day of January, 1974. (5) Said newspaper purports to serve the Village of Eden Prairie in Hennepin County and it has its known office of issue in the City of Bloomingicn In Hennepin County, established and open during its regular business hours for tiie gathering of news, sale of advertisements and sale of subscription arid maintained by the managing officer or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such business hours to the business of the newsppaer and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historial Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication 'intentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
