ORDINANCE NO. 243
AN ORDINANCE AMENDING ORDINANCE NO. 202 RELATING TO
LICENSING AND REGULATION OF THE USE AND SALE OF INTOXICATING
LIQUOR AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF
The Village Council of the Village of Eden Prairie ordains as follows:
Section 1. Licensing of Employees .
Subd . 1 . Ordinance No. 202 is amended by adding the following:
"Section 17 .
Subd . 1 . No person shall work as a manager, bartender, cocktail waitress,
clerk, delivery man, or in any capacity where such person sells,
serves , or delivers intoxicating liquor in or from premises licensed
under this ordinance , and no license shall permit any such person
to be so employed, unless such person, within seven days after
being first employed, shall apply for a license to engage in such
business . No person may be so employed for any length of time if
his license is denied or revoked. This section shall not apply to
persons employed in establishments licensed pursuant to Section 13
of Ordinance No. 202 described as on-sale club.
Subd 2 . No person shall make "off sale" deliveries of intoxicating liquor
in the original package within the Village unless such person has
obtained a license as an employee.
Subd . 3 . An application for such license shall be filed with the Village Clerk
upon forms provided by the Village and such application shall be
verified under oath and shall contain the following information:
(a) The names and addresses of two residents of Hennepin County,
Minnesota, who have known the applicant for a period of two
years and who will vouch for the sobriety, honesty, and
general good character of the applicant.
(b) A concise history of the applicant's previous employment.
(c) The record, if any, of arrests and of convictions for crimes
and misdemeanors other than traffic offenses .

Subd . 4 . The annual license fee shall be $10 .00 and shall be paid in advance .
All licenses shall expire on December 31 . Applications for renewal
of an existing license shall be made at least 15 days prior to the
date of the expiration of the license on such forms as the Village `l
Council may approve .

Subd . 5 . The application shall be referred to the Public Safety Department
which shall investigate the facts set forth in the application and make

a written report thereon at the earliest practicable time . If the Public
Safety Department recommends that such person be licensed , the
Village Clerk shall issue the license forthwith. If the Public Safety
Department makes a recommendation that the license not be issued ,
the applicant, upon request, shall be entitled to a hearing before
the Village Council and may offer evidence to prove the license
should be issued.
Subd . 6 . No person shall be issued a license if it appears that he has committed

an act which is a willful violation of Minnesota Statutes 340 . 07

through 340.40 .
Subd . 7 . Any license issued hereunder may be revoked for any violation of
this ordinance or Minnesota Statutes 340 . 07 through 340. 40 or
for conviction of any crime or misdemeanor involving moral turpitude. "
Section 2 . Section 17 of Ordinance No. 202 shall be redesignated as " Section 18" . r f
First read at a regular meeting of the Council of the Village of Eden Prairie this
1 lth day of December, 1973 , and finally read, adopted and ordered published at a
regular meeting of the Council of said Village on the 26th day of December, 1973 .

newspaper is circulated in and near the municipality which it purports to serve, has at least
500 copies regularly delivered to paying subscribers, has an average of at least 75% of Its total !
circulation currently paid or no more than three months in ar-rears and has entry as second-
class matt(r in its local post-office. (5) Said newspaper purports to serve the Village of }
Eden Prairie in Hennepin County and it has its known office of issue in the City of
Bloomingtcn in Hennepin County, established and open during its regular business hours for u
the gathering of news, sale of advertisements and sale of subscription and maintained by the
inanaging officer or persons in its employ and subject to his direction and control during all
such regular business Hours and devoted exclusively during such business hours to the +
business of the newsppaer and business related thereto. (6) Said newspaper files a copy of
each issue immediately with the State Historial Society. (7) Said newspaper has complied
with all the foregoing conditions for at least two years preceding the day or dates of publication
'mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior
to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the
Secretary of State and signed by the publisher of said newspaper and sworn to before a notary 4s,
public stating that the newspaper is a legal newspaper,
He further states on oath that the printed Ordinmce No. 243
hereto attached as a part hereof was cut from the columns of said newspaper, and was printed
one
and published therein in the English language, once each week, for successive weeks;
that It was first so published on Thurs the 7 day of February . 19 ?I;
and was thereafter printed and published on every to and including
the day of 19 and that the following is a printed copy
