Appendix A of Ordinance No 135 is amending by adding to Section •13, Township 116, Range 22 as follows: .: That part of Government Lot 6, Secti on'.13, Township 116,' Range 22, ; lying South of the Original Center line of State Highway No. 5, ex- cepting that part described as follows: Beginning at the point of intersection of the East line of said Government Lot 6 and the * _southerly right of way line of said State Highway; thence West along :-said Southerly right of way line a. distance of 261 feet; thence South in a straight .line to a point in & line drawn parallel with and 250 k feet South of said Southerly right of way line, which point is 264.7 ..feet West of the East sine of said Government.Lot 6, measured along said parallel line; thence East along said parallel . line to a point therein which is 14.7 feet West of the East. line of said Government Lot 6, 'measured along said parallel line; thence South on aiAine. parr- a11e1 with and 14.7 feet blest of the East line of said Government Lot ( ` -6 to a point 1563.95 feet South .of the Southerly line of State Highway No. 5 thence East to the Southeast corner of said Government Lot 6; ;thence North on the East line of Government Lot 6 to- the point of begin- ning. Subject to easement for highway purposes in State Highway No. 5. Containing 30. 6 acres . (I-5 Park and Public) Rezoning from District I-5 Park in PUD -73-10 to Office and Public with approximately 12. 6 acres to be dedicated to the public for -open space protection and approximately 18 acres for construction of 160, 000 sq. ft. of Offic a Building in conformance with the Rezoning Agreement May 2, 1974 First read at a regular meeting of the Council of the City of Eden Prairie this IIth day of December 1973 and finally read, adopted and ordered pub- lished at a regular meeting of the Council of said City on the 12th-- day of March.,-:--1974 . RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known as The Eden Prairie .Sun and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language In newspaper format and in column and sheet form equivalent in printed space to at lenit 900 square inches. 121 Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least y 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total f circulation currently paid or no more than three months in arrears and has entry as second- class matter in its local post-office. (5) Said newspaper purports to serve the Village of Eden Prairie in Hennepin County and it has its known office of issue in the City of ` Bloomingtrn in Hennepin County, established and open during its regular business hours for ? the gathering of news, sale of advertisements and sale of subscription and maintained by the managing officer or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such business hours to the business of the newsppaer and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historial Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication 'mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
