HomeMy WebLinkAboutOrdinance - 230 - Subdivision Regulations for Parks, Playgrounds, Public Open Space, Storm Water Holding Areas or Ponds - 08/28/1973 4: r a VILLAGE OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA Y ORDINANCE NO. 230 AN ORDINANCE RELATING TO AND ESTABLISHING SUBDIVISION REGULATIONS FOR THE PLATTING AND SUBDIVIDING OF LAND AND AMENDING ORDINANCE NO. 93, SECTION 11, SUBDIVISION 1, PARKS, PLAYGROUNDS, PUBLIC OPEN SPACE, STORM WATER HOLDING AREAS OR PONDS. The Council of the Village of Eden Prairie does ordain as follows: Section 11. Subd. 1. Parks, Playgrounds, Public Open Space, Storm Water Holding Areas or Ponds. The owner or owners of land being subdivided shall be required as a prerequisite to approval of the plat or subdivision to convey to the Village for public use as parks , playgrounds, public open space or storm water holding areas or ponds, a reasonable portion of each proposed subdivision, or that the subdivider contribute an � .__. equivalent amount in cash based on the fair market value of the undeveloped land provided that cash payments received shall be placed in a special fund by the municipality and used only for the acquisition of land for parks, playgrounds, public open space and storm water holding areas or ponds, development of existing parks and playground sites, public open spaces and storm water areas or ponds, and debt retirement in connection with land previously acquired for such public purposes. The Village Council setting forthethe reasonable portion of each proposed subdivision to be dedicated to the public for public use as provided above may take into consideration the open space park, recreational or common r" areas and facilities which the subdivider has provided for the exclusive use of the residents of the subdivision. (5) Said newspaper 'purports to serve the Village of Eden Prairie in Hennepin County and it has its known office of issue in the City of Bloomingtcn in Hennepin County, established and open during its regular business hours for life gathering of news, sale of advertisements and sale of subscription and maintained by the managing officer or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such business hours to the business of the newsppaer and business related thereto. (6) Said newspaper files a copy of each issue immediately with the State Historial Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January l thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
