CITY CENTER HERITAGE ROOM II 8080 MITCHELL ROAD BOARD OF APPEALS MEMBERS: Chair Kathy Nelson, Cliff Dunham, Delavan Dye, William Ford, Louis Giglio, Matthew Hansen, Corrine Lynch STAFF LIAISON: Zoning Administrator Jean Johnson and City Recorder Barbara Anderson MEMBERS ABSENT: None CALL TO ORDER Chair Nelson called the meeting to order at 7:30 p.m. ROLL CALL All members were present. . I. APPROVAL OF AGENDA MOTION: Dunham moved, seconded by Dye,to approve the Agenda as published. Motion carried 7-0. II. APPROVAL OF MINUTES OF NOVEMBER 14, 1996 MEETING Giglio requested a wording change to read, "limited"instead of"tied down'on page 7, second paragraph. MOTION: Giglio moved, seconded by Dunham,to approve the Minutes of the November 14, 1996 Meeting of the Board of Adjustments and Appeals as corrected. Motion carried 7-0. III. VARIANCES A. Request#97-014 Terry and Nancy McCormick at 6970-72 Alpine Trail to permit the expansion of a non conforming_structure in a R1-22 District(single family). Terry and Nancy McCormick, 6970 Alpine Trail, explained they need to expand their living space to accommodate a special needs child and also to give them extra garage space to enable them to park all their vehicles inside. The home was always intended to have only one driveway, and they did not object to that stipulation proposed by staff. BOARD OF ADJUSTMENTS AND APPEALS Thursday, January 9, 1997 Page 2 Lynch asked if they could add on somewhere else and Terry responded that there was a crawl space and if they added on elsewhere it would change the roof line to be awkward in appearance. Dunham inquired if they would have to go outside to gain access to the garage and Terry responded affirmatively. He noted they were moving a pine tree they wished to preserve, and they have 1.5 acres of area so there will be plenty of space to move it. Foot inquired if the garage addition would be for three cars and Terry responded that they were converting one half the existing double garage into living space and adding another two car garage so there would be parking for three vehicles when the project was completed. Johnson reviewed the staff report and noted that where were four options available to the Board. The proponents do meet all setback requirements and there was no opposition from neighborhood residents to the plans. The proposal is for the expansion of a non-conforming use and the variance is required because it is a duplex located in a single family zoning district. Staff would recommend that a stipulation be added to an approval that there be only one driveway to retain the appearance of a single family home. The Public Hearing was opened. • No one present wished to speak. The Public Hearing was closed. Dunham inquired if there were fire walls between the existing garage and living area. McCormick responded that they will have to add them when the construction is done, but there are none presently existing. Hansen asked if the Building Department had reviewed the plans and McCormick responded that they had not been submitted yet as they wished to have approval of the variance before proceeding with the project. Hansen inquired if there was another entrance door to the garage besides the garage door itself, and McCormick responded not into the existing garage but they were going to put one into the added double garage portion. Nelson inquired if the proposed addition would give them the necessary additional space so that they would not be back requesting more variances in the future, and McCormick responded that this would be adequate and enable them to remain in their home and keep their children in their present schools, which is why they had requested the variance. MOTION: Giglio moved, seconded by Dye, to approve Variance Request#97-01 for Terry and Nancy McCormick at 6970-72 Alpine Trail to permit the expansion of a non- conforming structure in a R1-22 District(single family)with the stipulation that there be only one driveway and the plans be approved by the Building Department. OLD BUSINESS Nelson thanked the members of the Board who attended the Joint Meeting of the Board of Adjustments, the Planning Commission and the City Council. She encouraged all members to attend the next joint meeting,which has yet to be scheduled, as it was most beneficial. V. NEW BUSINESS A. Distribution of the Senior Issues Task Force Report B. Distribution of Livable Communities Action Plan for Eden Prairie. Johnson distributed both the Senior Issues Task Force Report and the Livable Communities Action Plan and requested Board members to read both of these documents. Johnson commented the City Council had created the Senior Issues Task Force to study issues facing senior citizens in Eden Prairie and to propose recommendations to facilitate people remaining in the community. The City Council has requested that all Boards and Commissions become familiar with the report and its recommendations. Nelson commented that this report would factor into the next joint meeting of the Board of Adjustments,the Planning Commission and City Council along with the Livable Communities Action Plan for Eden Prairie. She noted that affordable housing was necessary in Eden Prairie and there will be more plans coming in for review of that type. Dye commented that somewhere in the future they will have to start building high rises to have effective use of the land. He believed there was high density residential land in the City Center area where this could be done. VI. ADJOURNMENT MOTION: Dye moved, seconded by Lynch,to adjourn the meeting. Motion carried 7-0.
