HomeMy WebLinkAboutOrdinance - 175 - Regulating Operation of Motorcycles, Mini-bikes and all Terrain Vehicles - 06/13/1972 VILLAGE OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 175 AN ORDINANCE REGULATING THE OPERATION OF MOTORCYCLES, MINI-BIKES AND ALL TERRAIN VEHICLES. The Village Council of the Village of Eden Prairie ordains as follows: Section I. Definitions : For the purpose of this ordinance the terms defined herein shall have the following meanings ascribed to them. Subd. I. "Vehicle" means every device in, upon or by which any person or property is or may be transported or drawn, either upon a highway or other surface, except devices moved by human power. Subd. 2. "Motor Vehicle" means every vehicle which is self propelled. 1 Subd. 3. "Public Property" is propery that may be used by all of the public subject to regulation by a governmental body or School Board. Such property includes Village parks and parking lots and school yards and park- ing lots. Sub d. 4. "Private Property" means all property except public property, and streets and highways. Subd. "Street or Highway" means the entire width between boundary lines of any way or place when any part thereof is open to the use of the public, as a matter of right, for the purposes of vehicular traffic. Section 2. It shall be unlawful for any person to operate any vehicle or motor vehicle upon public property other than on a surface designated or designated for vehicular use. Section 3. It shall be unlawful for any person to operate or permit to be operated any vehicle or motor vehicle upon private property which is not held open to the public for vehicular use, without the permission of the owner or occupant. Section 4. No person shall operate a vehicle or motor vehicle on public or private property within the Village of Eden Prairie at a speed greater than is safe and reasonable under the conditions then existing. The maximum speed shai 1 be 25 m.p.h. Section 5. No person under 15 years of age shall operate any vehicle or motor vehicle on any property located within the Village of Eden Prairie other than upon private property with the permission of the owner thereof. No person may operate any vehicle or motor vehicle in a careless or heed- less manner; in disregard of the rights or safety of others, or in a manner so as to endanger or be likely to endanger any person, animals or property. Section 7. The hours of use of vehicles and motor vehicles are 7:00 a.m. to 11 :00 p.m. except upon streets and highways, and private property which is at the time of use, hel d open to the publ i c for vehicular use for the purpose of gaining access to a place of residence for the purpose of access to goods and/or services. Section 8. By resolution: The Village Council may designate areas owned or controlled by the Village for the use of vehicles or motor vehicles and establish such rules and regulations as it deems necessary. The areas designated may be changed from time to time by the Village Council. Licenses may be required and fees may be charged to cover costs incurred. Section 9. An up-to-date map of designated areas for vehicle and motor vehicle use shall be kept on file in the Village Office, a copy of such map together with the rules and regulations of registration and licensing shall be provided to each person requesting such information from the Village. Section 10. Minimum Equipment Requirements. Subd. 1 . Standard mufflers which are properly attached and in constant operation and which reduce the noise of operation of the motor to the minimum necessary for operation. No person shall use a muffler cutout, bypass, straight pipes or similar device on a vehicle, motor vehicle, motor cycle, and the exhaust system shall not emit or produce a sharp popping or crackling sound. Subd. 2. At least one clear lamp attached to the front with sufficient intensity to reveal persons and vehicles at a distance of at least 100 feet ahead during the hours of darkness under normal atmospheric conditions. Such head lamp shall be so aimed that flaring rays are not projected into the eyes of an oncoming vehicle operator. It shall also be equipped with at least one red tail lamp having a minimum candle power of sufficient intensity to exhibit a red light plainly visible from a distance of 500 feet to the rear during the hours of darkness under normal atmospheric conditions. This equipment shall be required and shall be in operating condition when the vehicle is operated between the hours of one-half hour after sunset to one-half hour before sunrise or at times of reduced visibility. The Village Council of the Village of Eden Prairie hereby declares that shou 1 d any section, paragraph, sentence or word of this Ordinance be declared for any reason to be invalid, it is the intent of the Village Council of the Village of Eden Prairie that it would have passed all other portions of this Ordinance independent of the elimination herefrom of any such portion ' as may be declared invalid.
