AN ORDINANCE AMENDING ORDINANCE
NO. 93 RELATING TO DIVISION Of LAND
Section 1 . Section 3 of Ordinance No. 93 is hereby amended to read as follows:
Scope of this Ordinance: The provisions of this ordinance relate to any
division of a tract of land into two or more parcels by platting, re- y
platting, conveyance, registered land survey, or other means, except when
such division results in a parcel having an area of not less than five (5)

acres and having a width of not less than 300 feet.
Subd. 1 . Administrative Approval . The Village Manager or his designated
representative may authorize land divisions subject to this
Ordinance upon his finding that :

1 . The division will not result in more than two parcels.
2. The division does not necessitate the dedication of a
public right-of-way.
3. If a lot which is part of a plat recorded in the office of $
� ., the Register of Deeds of Hennepin County is divided that
such division will not cause any structure on the lot to
be in violation of the Zoning Ordinance or said new portions
of lots to be in violation of Village Ordinances.
4. The resulting parcels generally conform to the shapeand area
of existing or anticipated land divisions in the surrounding
areas.
5. The resul ting parcel s wi t 1 not i n any way interfere wi th the
purposes, objectives or provisions of the Village's Com-
prehensive Planning, Platting and Zoning policies or
Ordinances.
b. No objections to the proposed divisions are presented by
coati gnus property owners following their mailed notification
of the proposal .
FIRST READ at a regul ar meeti ng of the Counci 1 of the Vi i i age of Eden
Prairie this 28th day of September, 1971 , and finally read and adopted and ordered pub-
lished at a regular meeting of the Council of said Village on the 12th day of October,
1971 .

class matter in its local post-office. (5) Said newspaper purports to serve the City of Minne-
tonka and Village of Eden Prairie in Hennepin County and it has its known office of Issue

business hours for the gathering of news, sale of advertisements and sale of subscriptions and
maintained by the managing officer or persons in its employ and subject to his direction and
control during all such reg-ilar business hours and devoted exclusively during such regular
business hours to the business of the newspaper and business related thereto. (6) Said newspaper
files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has
complied with all foregoing conditions for at least two years preceding the day or dates of
publication mentioned below. 18) Said newspaper has filed with the Secretary of State of
Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form
prescribed by the Secretary of State and signed by the publisher of said newspaper and Sworn
to before a notary public stating that the newspaper is a legal newspaper. i
