VILLAGE OF EDEN PRAIRIE
HENNE PIN COUNTY, MINNESOTA
ORDINANCE NO. 123
AN ORDINANCE RELATING TO ZONING AND AMENDING ORDINANCE
NO. 8 OF THE VILLAGE OF EDEN PRAIRIE. .
The Council of the Village of Eden Prairie does ordain:
Section I . Ordinance No. 8, Section 8.8 E is hereby amended by deleting

the terminology contained therein and substituting the following :
E. PLANNED UNIT DEVELOPMENTS
I . Purpose. The Planned Unit Development (P,U.D.) provision
of th s ordinance is to allow substantial variation from the
provisions of this ordinance including uses, set backs, x
height, lot area, width and depth, yards, etc., in order to:
a) encourage more creative design and development of land.
b) promote variety in the physical development pattern of
the Village.
c)concentrate open space in more usable areas or to preserve
unique natural resources of the site.
d) preserve and provide a more desirable environment than
would be possible under street interpretation of The
Zoning Ordinance.
2. Procedure. The Village Council may issue a Conditional Use
Peelr�mii`ffor a P.U.D. in accordance with Complete Preliminary
Development Plans for an integrated and coordinated site
development project . The permit shall not be considered
finally approved until all Final Design Details have been
approved by The Engineer, Planner and Attorney.
3. Preliminary Plan Elements, Applicant must provide the
following information in preliminary form (not construction
drawings and specifications):
a) Com rehensive Development Plan,and Perspectives which
will adequately and accura ely describe the proposed
development including location of buildings, roads,
parking, landscaping, lots, public space and other
features.
b) Land-Use Plan indicating approximate land divisions and
nearest existing zoning classification requested for each
division.
Approximate building floor areas with breakdown by use
for commercial and industrial uses, parking area capacity,
proposed population and projected breakdown, hours of
operation for commercial or industrial uses, and other
land use or density information necessary to understand
the plan and operation proposal .
c) Access, Circulation and Parking Plan indicating alignment
and grades for all roads an streets, parking access, and
general pedestrian and service circulation.
d) Landscape Development Plan including plan and elevation
sketches which clearly describe plant masses, walls, slopes, {
fences and other landscape structures.
e) Grading and Drainage Plan indicating general drainage patterns,
areas, runoff computations and preliminary sizing for drainage
structures and storage areas, flood levels and other appropriate
data, including preliminary review reports from appropriate
state and other agencies with jurisdiction over the site.
f ) Utilities Plan including provision for water supply and
alstri ution, sanitary sewers and disposal ( if no public
sewers are available), gas, electric and telephone distribution,
street and area lighting plan, and a garbage and refuse
system for high density multiple dwelling developments °
(R3a and up) . Applicant must submit preliminary review
report of appropriate state health and pollution control
agencies.
g) Specific Enumeration of all variances and exceptions requested.
h) Legal Documents required to describe property, ownership
and opera ►oval rights and obligations of tenants or other
owners, ownership operating, and maintenance responsibilities
for private streets, utilities, drainage structures and
open space areas.
i ) Development Schedule which indicates areas and facilities
to be aevelopea initially, together with a projection of
future development phases and target dates.
4. Final Development Design or Plat Elements. Applicant must
provide final detail design drawings and specifications only
for that part of the development to be constructed. So tong
as the plan details and specifications are found to be sub-
stantially in keeping with The Approved Preliminary Plan
Elements in fact or intentkupon review and approval of The
Engineer, Planner and Attorney, permits for building shall be
issued without further review by The Council or Planning and
Zoning Commission. Substantial departures from Preliminary
Plan proposals must be submitted to the Village Council forr
consideration of an amendment to the conditional use permit. .
5 The Qevelo er is encouraged to utilize the services of
• trained and experienced Site Planners, Landscape Architects, '4
Architects and Engineers to prepare all plans and detailcd
designs, in order to enable the most expeditious processing
of applications, with the least time and expense involved for
The Planner, Engineer-, and Attorney.
6. The Village will provide all basic working drawings and
spell i ca t i on for areas to be dedicated for public use and
for the general landscape planting plan as well , actual 3
planting and development of initial park and recreation
facilities shall remain the responsibility of the applicant. I
7. The Village may require appropriate performance and other
guarantee -bonds in order to insure compliance with approved
development plans and specifications.
