THE V I LLAGE COUNC I L OF THE V 1 LLAGE OF EDEN PRA I RI E DOES ORDAIN: Section I . Definition - Deadly Weapons. The term "deadly weapon" as used herein, sha I I inc I ude the f of I ow ing: ( I ) A 1 I f i rearms; (2) Bows and arrows when arrows have pointed tips; (3) At instruments used to expel in high velocity any pet lets of any kind, including but not limited to BB guns and air rifles; (4) Sling shots; (5) Sand clubs; (6) Metal knuckles; and (7) Daggers, dirks, and knives. i Section 2. Except as herein specifically authorized, all discharg- ing and use of deadly weapons within the Village of Eden Prairie is hereby 9 prohibited. t Section 3. Except as hereinafter provided, no person shall have in his possession any gun, pistol or firearm of any description within the limits of the Village of Eden Prairie unless said pistol , gun or firearm is located within his home, dismounted or broken apart, or carried in a case in such a manner that it cannot be discharged, nor shall any person carry or conceal any pistol or firearm upon his person. Section 4. Persons desiring to f ire off or discharge any gun, pistol or other firearm or use any weapon as hereinbefore defined within the V i I 1 ag a of Eden Prairie shall f i rst secure a permit to do so from the Village Council . Section 5. Application for such permit shall be in writing addressed t _l SY, r y to to the Village Council accompanied by a fee of $2.00 and shall state the .5 period for which such permit is desired, type of gun, rifle, pistol , air -' rifle, BB gun, or weapon to be fired or used, the location of the target area, the type of facilities to be used, and such other information as may be deemed necessary by the Councif to pass upon such application. Such permit shall be in writing and shall be issued by and at the discretion of the Council . Said permit shall be usable only by the person to whom issued. Section 6. Shooting by an organized gun club is prohibited within the Village, provided, however, that the council may upon application issue a permit to an organized gun club upon a showing that such shooting by the gun club would not be detrimental to the use and enjoyment of the adjoining property. Section 7. Nothing herein shall be construed to prohibit any firing of a gun, pistol or other weapon when done in lawful defense of person, property or family, or in the necessary defense or enforcement of laws. Section 8. Penalties. Any person violating the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not to exceed $100.00 or imprisonment for not to exceed 90 days. Section 9. Repeals. Ordinance No. 55 of the Village of Eden Prairie is hereby repealed. Section 10. This Ordinance shall take effect and be enforced from and after its adoption.
