HomeMy WebLinkAboutOrdinance - 86 - Curfew Ordinance - 09/28/1966 VILLAGE OF EDER PRAIRIE 4 HENNEPIh- COUNTY, MINNESOTA k ORDINANCE NO. 1 AN ORDINANCE REGULATING THE PRESENCE OF MINORS UNDER THE AGE OF EIGHTEEN (18) YEARS IN PUBLIC STREETS AND OTHER PLACES BETWEEN CERTAIN HOURS AND DEFINING DUTIES OF PARENTS AND OTRERS IN CARE OF MINORS. v The Village Council of the Village of Eden Prairie hereby '¢ ordains as follows: Section 1. Minors under 15. :s Subdivision 1. It shall be unlawful for any minor under the age of 15 years to be on or present upon any public street, avenue, alley,park, playground, or place open to the public, or place of amusement and entertain- ment, vacant lot, or other unsupervised place in the Village of Eden Prairie between the hours of 10:00 P.M. of any day and 5:00 A.M. of the following day. Subdivision 2. The provisions of this section shall not apply to any such minor who is accompanied by his or her parent, guardian or other adult person having the authorized care and custody of such minor or when f such minor person is upon an emergency errand or is proceeding without t loitering or idling directly to or from school, community, or family function or business directed by his or her parent, guardian, or adult person having authorized care and custody of such minor. Subdivision 3. The fact that such minor, unaccompanied by parent or guardian or other adult person having authorized care and custody of such minor is found upon or in any such place within the Village after said 10:00 P.M. and before said 5:00 A.M. shall be prima facie evidence that said minor is there unlawfully. Section 2. Minors 15 to 18 ' Subdivision 1. It shall be unlawful for any minor under the age of 18 years and over the age of 1.5 years to loiter, idle, wander or play in or upon any public street, avenue, alley, park, playground, or place open to the public, or place of amusement and entertainment, vacant lot, or other unsupervised place in the Village of Eden Prairie between the hours of 12:00 midnight and 5:00 A.M. of the following day. Subdivision 2. The provisions of this section shall not apply to any such minor who is accompanied by his or her parent, guardian or other adult person having the authorized care and custody of such minor person, or is engaged in play or organized youth activity under the direction of a school, church or community organization. Subdivision 3. The fact that such minor unaccompanied by parent or guardian or other adult person having authorized care and custody of such minor person, is found to be loitering, idling, wandering, or playing in any such place within the village after said 12:00 midnight and before 5:00 A.M. shall be prima facie evidence that said minor is there unlawfully. Section 3. Liability of a Parent. It shall be unlawful for any parent, guardian or other adult person having authorized care, custody or control of any minor under 18 years, to allow or to permit such minor to violate the provisions in Sections 1 and 2 of this ordinance. Section 4. Liability of Proprietor. It shall be unlawful for any person operating or in charge of any place of amusement, entertainment or refreshment, or other place of business, to permit any minor under the age of 18 years to loiter or idle 4n such place contrary to the provisions of Sections 1 and 2 and he shall immediately order such minor person to leave, and if such person refuses to leave such place `k he shall immediately notify the police department of the violation. i Section 5. Construction. t This ordinance shall not be construed as permitting the presence at any time of any person under the age of 18 years in any place where his presence is now prohibited by any existing law or ordinance. Section 6. Penalty. Subdivision 1. Any minor tinder the age of 18 years found on or in any public street, avenue, alley, park or other place, in violation of Sections 1 and 2 hereof, may be sent or taken home or placed under proper custody by any police officer of the village. Subdivision 2. Any minor violating the provisions of Sections 1 and 2 hereof shall be dealt with in accordance with Juvenile court law and procedure. Any person, guardian or other adult person or persons having authorized care and custody of such minor, violating Sections 1 and 2 hereof shall be guilty of a misdemeanor.
