AN OP-PIK4A:CE ESTABLISHI'.G A 117BLIC REMMIATIONT AND PARK Ct}hihiISSIO?v' FOR THE VILLAC;F OF M)FN MAMIE, MINNESOTA, BE IT ORDAINED by the council of the Village of Eden Prairie: Section 1. Subdivision 1. There is hereby created a Recreation and Park commission for the Village of Eden Prairie, Minnesota, consisting of five (5) members to be appointed as follows: One member from the Board of Education of Independent School District Mo. 2- 7 2 to be appointed by that Board for a term of three (3) years; One member from the Village Council to be appointed by the Council for a term of three (3) years ; Three members at large, two (2) for terms of two (2) years and one (1) for a term of one (1 ) year, at least one of which shall be a woman, to be appointed by the , mayor with the approval of the Village Council Subsequent appointments shall be made for three (3) year terms or until successors are appointed and qualified. Subdivision 2. ?Members of the Commission shall serve without compensation a and their respective terms of office shall expire at the end of the time for which they are appointed, not to exceed their term of office for which they have been elected to the respective governing bodies. Subdivision 3. Immediately following appointment of, and acceptance of such appointment by, all members of the original Commission, it shall meet and organize by electing such officers as may be necessary, and adept such rules, by—laws and regulations for the conduct of its work as it deems necessary and Advisable. The commission shall meet at least once each month. Three members present at a regular or special meeting of the commission shall constitute a quorum. r Section 2. The Commission shall advise in conducting a public recreation program for the Village of Eden Prairie and its immediate vicinity and to that end r f. shall advise in the providing, conducting and supervising of recreation areas, facilities, services and programs for public recreation in its broadest sense, including playgrounds, parl.s, playflelds, swimming pools, beaches, camps, indoor s recreation centers and any and all other recreation facilities and activities either within or without the corporate limits of the Village upon property under the custody and mina-caient of the Village or on other public or private property with the consent of the owners of such property. The Commission shall be charged with the controb, z° development, management, operation, and maintenance of a system of parks and recreational areas now in existence or that may hereafter be acquired and shall be charged with the supervision and maintenance of playgrounds, playfields, bathing beaches, swimming pools, recreation centers and other recreation and park activities, areas and a facilities. The Commission shall advise the Village in the operation of barks and recreation areas and facilities now owned or hereafter acquired by the Village, and may advise the Village to enter into agreements of a cooperative nature with other public and private agencies, organizations or individuals when, in the judgment of the commission, such procedure would prove advantageous, Section 3. Subdivision 1 . The Commission shall have the power to recommend to the Village Council the employment of a trained and qualified superintendent of recreation and such other expert assistants, supervisors, directors, play leaders and teachers, inspectors, engineers, caretakers and other employees as may be necessary in its judgment, for the efficient administration, conduct and development of the public recreation pystem of Eden Prairie and its immnediate environs. Subdivision 2. The superintendent of recreation may, with the approval of the Villa;re Council, serve as the executive officer of the Commission and may act as ( its secretary, in a relation similar to that of the superintendent of Schools to the A d Board of Education. It shall I)e the duty of the Recreation Commission to make �i recommnendations to the Village Council concerning the property acquisitions needed to cozaplete a cola ;rehet29ive recreation system. Section 4. The Commission sliall , on or before each September first render z a full report to the Village Council covering; its operation for the preceding 12 moi.ths, to—lether with its recoimmeiadations and an estimate of the funds required for its work for the ensuing year. It shall also render such other regular or special reports , advisory recommendations or zinke such investigations as it deems advisable, or as may be requested by the Village Council or the school boards. Section 5. A recreation fund shall be established in the Village budget x° into which all taxes levied and collected for recreation purposes and all gifts, bequests or endowments of money as donations or grants from persons, firms or corl)orations including government agencies and all fees and charges for recreational servides or facilities shall be deposited. The Com=ission by actiov taken in regular or special a . meetings of the commission may advise the Village Council as to disbursements from said fund.
