Duties of the Village Clerk. Subdivision 1. The Village Clerk shall issue all village licenses or transfers of licenses authorized by this ordinance after approval thereof by the Village Council, Subdivision 2. Applications. Every applicant for any license or transfer of a license to be issued or granted under the authority of this k ordinance shall make an application for such license or transfer on a form to be furnished by the town and shall pay to the town the full amount of the license or transfer fee required by this ordinance. all questions on the application blank Faust be answered and all the information required must be furnished. Any application for a license made by an individual owner shall be signed and sworn to by such owner, and if made by a partnership, shall be signed and sworn to by one of the partners, and if by a corporation, by one of the duly elected officials of the corporation. Subdivision 3. Issuance of a license. The Town Board shall make such investigation of the application and the person applying for such license or transfer as it dooms necessary and shall, within thirty days from the date of filing such application and the payaent of the license or transfer fee, whichever is later, either authorize the Village Clerk to issue the license or transfer or deny such application. If the application is denied the amount of the license or transfer fee shall be refunded to the applicant. , a h fi Subdivision 4. Revocation. The Village Council may revoke any license after giving the licensee at least seven days ' notice by registered t mail at the licensee 's address shown on the license application or if none r �t is shown, at the licensee 's last known address, of the intention of the Village Council to revoke such license and giving the licensee an opportunity to appear before the Village Council and be heard with reference thereto. Section 2. Subdivision 1. No person, firm or corporation shall directly or indirectly, or by means of any machine or device, keep for retail sale, sell at retail or otherwise, dispose of any cigarettes or cigarette wrapper at any place in the Village of Eden Prairie unless a license therefore shall first have been obtained from the Village. Subdivision 2. Fee. The fee for every license shall be � � it., o J fi per year. Subdivision 3, Reguirements. No license shall be issued except to a person or good moral character. No license shall be issued to an applicant for a sale of cigarettes at any place other than his established place of business. No license shall be issued for the sale of cigarettes at a movable place of business, nor shall any license be issued for the sale of cigarettes at more than one place of business. No person, firm or corporation shall sell or give away any cigarettes, cigarette papers or cigarette wrappers to any person below the age of eighteen years& or to any minor pupil in school. No person shall keep for sale, sell, give away or otherwise dispose of any cigarettes or cigarette wrappers containing opium, morphine, jimson weed, bells donna, strychnia, cocain, marijuana, or any other deleterious or poisonous drug except nicotine. c Subdivision 4. Fnforecement. For the purpose of enforcement of this ordinance or any other ordinance of the Village or laws of the state, any police } ' officer of the village or anyone duly designated by the Village Council shall be given admittance to any public entertainment licensed hereunder to discover or prevent any violation of the laws and shall be given full information upon request a by any licensee. Subdivision 6. Penalty. Any person, firm or corporation who shall engage in or Follow any business or occupation for which a license is required by this ordinance without having obtained such a license and any firm, person or corporation who shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor.
