HomeMy WebLinkAboutOrdinance - 20 - Establishing Standards for Roads and Streets - 05/09/1961 r TOWN OF EDEN PRAIRIE HENNEP I N COUNTY, M i NNESOTA 1 ORDINANCE NO. 20 AN ORDINANCE ESTABLISHING STANDARDS FOR THE CONSTRUCTION OF STREETS AND ROADS BY SUBDIVIDERS WITHIN THE TOWN OF EDEN PRAIRIE& PROVIDING SPECI- FICATIONS FOR CONSTRUCTION MATERIALS AND METHODS, PROCEDURES FOR SUPERVISION OF CONSTRUCTION AND PROVIDING PENALTIES FOR VIOLATION THEREOF. DEFINITIONS: (a) 'Town" means the Town of Eden Prairie; (b) "engineer" means the town street engineer or his agent; ' (c) "specifications" shall mean the designs, standards, $ requirements and directions prepared by the engineer, as accepted by the Town Boards (d) The term "work" includes materials and labor; and ce) "Subdivider" means owner or developer. Section 1 . PURPOSE AND JURISDICTION. Pursuant to applicable statutory authority of the town to regulate, control and maintain town streets as provided in Minnesota Statutes, the following regulations, standards, specifications and inspection procedures are established. The specifications for town street construction by subdividers on file in the office of the Town Clerk shahl apply to the construction of the streets in all subdivisions or plats receiving the preliminary approval of the Town Board following adoption and publiaation of this ordinance. Section 2. SURETY BOND TO GUARANTEE WORK BY SUBDIVIDERS. The sub- divider shall furnish a surety bond in an amount equal to one and one-half times the cost of the work estimated by the engineer. The conditions and form of said bond shall be prescribed by the Town Board. y Section 3. PARTIAL STREET CONSTRUCTION. The subdivider may be per- mitted to complete the streets limited to that portion of the plat which he proposes to first develop and record. 4' X /^ Section 4. CONSTRUCTION OF STREETS. The sp ec;f i cat tons for town N street construction shall be the minimum standard and shall apply to all streets + which are to be offered to the town for acceptance for maintenance. Section 5. ENGINEERING. The supervision of construction shall not be considered to include the stake--out, establishment of grades or similar work. Such engineering shall be done by the subdivider's engineer. Section 6. INSPECTION FEE. The subdivider shall pay to the town an inspection fee of fifteen cents per iineal foot measured along the center line of the street with a minimum fee of $150.00 per plat or the portion thereof to be recorded, as provided in Section 3 above, to insure compliance with the f specifications. t The cost of any extra inspection made necessary by failure of the subdivider to promptly meet the specifications shad be charged to the sub- divider at the rate of $6.50 per hour. Section 7. INSPECTION BY TOWN STREET ENGINEER. The engineer shall be a registered civil engineer and shall be appointed by the town board. Section 8. PARTIAL MAINTENANCE. When a street has been completed to a point where it is suitable for snowplowing, such operations will be carried on at the expense of the town. Snowslowing shaft in no way constitute acceptance for other maintenance and shall have no effect upon agreements between the town and the subdivider. Section 9. FINAL ACCEPTANCE. Final acceptance of streets shall be in accordance with provisions of the surety bond after theissuance of a certi- ficate of approva► by the engineer. Section 10. VARIATION AND EXCEPTION. The town board may permit vari- attons from these requirements in specific hardship cases, and in its discretion may enter Into an escrow agreement when a surety bond cannot be obtained by the subdivider. Section 11 . VALIDITY. Should any section, cieuse, sentence or provision of this ordinance be declared by the courts to be invalid, the same shall not affect the valTdity of this ordinance as a whole, or any pert thereof ' E r i i 1 other than the part so declared to be Invalld. Section 12. EFFECTIVE DATE. This ordinance shall be in force and effect from and after its passage and publTcatlon. Section 13. PENAL-T I ES FOR VIOLATION. Any person, firm or corporation violating any of the provisions of this ordinance or Interfering with any of f a Its agents or employees In the admTnistration of this ordinance shalt be E guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not to exceed $100.00 or Imprisonment in a public jail for not to exceed ninety days.
