ORDINANCE NO. 3
AN ORDINANCE RELATING TO THE REGULATING OF AND THE ISSUING OF
LICENSES BY THE TOWN OF EDEN PRAIRIE FOR DRIVE IN THEATERS .
THE TOWN BOARD OF EDEN PRA M I C DOES ORDAIN:
Section 1. DUTIES OF THE TOWN CLERK.
Subdivision 1. The Town Clerk shall issue all town licenses or
transfers of licenses authorized by this ordinance after approval thereof by the

Subdivision 2. Applications. Every applicant for any license or

transfer of a license to be issued or granted under the authority of this ordinance

shall make an application for such license or transfer on a form to be furnished by
the tcwn and sha I I pay to the town the fu I I amount of the I i cense or tr ansfer fee
•-- required by this ordinance. All questions on the application blank must be answered
and a I I the information required must be furnished. Any application for a License made
by an individual owner shall be signed and sworn to by such owner, and if made by a

Subdivision 3. Issuance of a license. The Town Board sha i l make such
investigation of the application and the person applying for such license or transfer
as it deems necessary and shall . within thirty days from the date of filing such
application and the payment of the license or transfer fee, whichever is later, either
authorize the Town Clerk to issue the license or transfer or deny such application,
If the application is denied the amount of the license or transfer fee shall be re-
funded to the applicant. r
Subdivision Revocation. The Town Board may revoke any license

after giving the licensee at least seven days' notice by registered mail at the

licensee's address shown on the license application or if none is shown, at the
licensee's last known address, of the intention of the Town Board to revoke such Y
license and giving the licensee an opportunity to appear before the Town Board and

be heard with reference thereto.
Section 2. DRIVE IN THEATERS.
Subdivision 1 . Drive in theater means an enclosed area into which
patrons drive with motor or other vehicles and view the moving picture screen' or

stage on which the entertainment is presented to the occupants of such vehicles.
Not more than one license for a drive in theater sha I 1 be issued in the Town of
Eden Prairie.
Subdiv;c;on 2. Application. The application for such license shall
give the name and address of the applicant, nature of the entertainment, the time
and duration thereof, method of advertising, reference as to financial responsibility
of applicant and such other information as the Town Board may require from time to time.
Subdivision 3. Fees. Such application sha 1 i be accompanied by a fee of
$300.00. The license fee for drive in theaters shall be $300.00 per calendar year,

Subdivision 4. Conditions. Every licensee shall comply with the
following conditions:
(a) Provide sufficient policemen at its own cost and expenseto regu-
late the traffic to and from the theater, all such policemen to b9 first approved
by the Town Board, and the number of such po I icemen necessary for such purpose to be y
determined by the Town Board;
(b) Completely screen the drive in theater with shrubs or a fence,
all subject to the prior approval by the Town Board;

orders and regulations as may be promulgated by state law or by further ordinance of
this town, or by any duly constituted municipal or state authority having to do with
public health, safety and welfare. a
Subdivision 5. Enforcement. For the purpose of enforcement of this

ordinance or any other ordinance of the town or iaws of the state, any police officer
of the town or anyone duly designated by the Town Board shall be given admittance to
any public entertainment licensed hereunder to discover or prevent any violation of
the laws and shall be given full information upon requast by any licensee in regard-
ing coming attractions.
Subdivision 6. Penalty. Any person, firm or -corporation who shall
engage in or follow any business or occupation for which a license is required by
this ordinance without having obtained such a license and any firm, person or corpor-
ation who sha I l vic,Iate any of the provisions of this ordinance sha I i be guilty of a
misdemeanor.
