HomeMy WebLinkAboutBoard of Adjustments and Appeals - 11/11/1982 APPROVED MINUTES BOARD OF APPEALS AND ADJUSTMENTS THURSDAY, NOVEMBER 11 , 1982 7:30 PM, CITY HALL BOARD OF APPEALS MEMBERS: Chairman, James Wedlund, Richard L\/nch, Ron Krueger, Roger Sandvick, and James Dickey BOARD STAFF: Wayne Sanders, Building Official and Lynda Diede, Recording Secretary ROLL CALL: James Dickey was absent. I. MINUTES A. Minutes of October 14, 1982. MOTION: Lynch moved, seconded by Krueger, to approve the Minutes of October 14, 1982. Sandvick abstained. Motion carried. II. VARIANCES A. Request #82-30, submitted by George A. Butler Construction Company, for property located at 8568 Hiawatha Avenue. The request is for a variance from Ordinance #135, Subd. 2.2 c to allow a sideyard . setback of 23' on a corner lot. George Butler, of Butler Construction Company, displayed a model of the home. He stated that it will be a "spec" home and consist of 2200 square feet. Lynch inquired if Butler felt that the home and lot were somewhat unique or would others need a variance in the future. Butler felt that the rest of the property, as far as he could tell, would not need a variance. Lynch asked the value of the home. Butler responded $140,000. Sanders wondered if it was necessary to merchandise the area to get - the house in there to help the total area. Butler stated yes. Sandvick inquired if the development was Butler's. Butler stated yes, although he didn't plat it; he bought it from the developer, Richard Smith. Krueger felt it is a narrow corner lot to deal with. Butler agreed, however, the street is curving. Sandvick asked the width of the lot next to Butler. Butler answered 86' . • He feels that there are a lot of additions in the City that do . allow the 20' setback automatically. -2- Board of Appeals and Adjustments November 11 , 1982 Wedlund pointed out that Butler has two front yard setbacks. The • problem is that it is a corner lot and he has two front yards. Krueger stated that the lots should've been platted larger. Sandvick wondered if another concept for the lot could have utilized. Butler responded that there was more impact with this design. Sandvick was concerned if we were entertaining a variance here to enhance someone monetarily or to grant a variance for the health and welfare of the owners of a lot in Eden Prairie. Lynch stated that he doesn't have concern for the monetary gain or loss for Butler. He feels that Butler has a valid point as others in the City are platted that way. His lot is unique with two front yard setbacks. The point that bothers him is the fact that several developers over the years,from the initial concept of the PUD, did come in and establish sideyard setbacks that have nothing in common with the ordinance. Butler isn't really overburdening the lot. Sandvick feels that it is a marketable item and the design could be changed. Lynch has concern for the other six or seven lots that are adjacent across the street. He doesn't want this to set a precedence for the other lots. MOTION: Wedlund made a motion to approve Variance Request #82-30, submitted By George A. Butler Construction Company. His findings are: He doesn't see that the decision could harm the health and welfare of the City of Eden Prairie. His main concern is to have decent' site lines for traffic. Exceeding the variance by 7' will not cut it back substantially. The house will enhance the area. If it were to instill sales for an area, it would improve the position of Eden Prairie and make for an attractive area. Krueger seconded the motion. Sandvick inquired if it was a 23% variance. Sanders stated yes. Sandvick voted nay. Motion carried. They have one year to exercise the petition. B. Request #82-31 , submitted by Donald P. Revier, for property located at 14300 & 14302 Golf View Drive. The request is for a variance from Ordinance #135, Section 2, to allow a lot of 5524 square feet, instead of the required 6500 square feet. Lynch inquired if a double would be built. Revier stated that the double building is already built. Lynch asked why they were splitting the bungalow. Revier replied that they were dividing it to get it equal . • Lynch stated that this is not unusual . It has happened before. He asked Revier if the neighbors are amenable. Revier replied yes. -3- Board of Appeals and Adjustments November 11 1982 Sandvick asked why there isn't 6500 square feet on each lot. Revier stated it was because of the L-shaped plan. They want to keep the center line in the middle of the unit. Krueger stated that topographically the lot slopes to the south. If the line was in back of the unit the north side would have a large lot and the south side a small lot. Wedlund asked if there was a proper fire wall and if it met the fire code. Sanders stated yes. MOTION: Lynch made a motion to approve Variance Request #82-31 , submitted by Donald P. Revier. This specifically is to allow two individual lots rather than a single lot, one being 5524 square feet instead of the required 6500 square feet. The property is at Lot 3, Block 1 , Golf Vista. His findings are: It is not an unusual situation. Several incidents have been taken before the Board in the past. It will not have detrimental effects to the health and welfare of the citizens of Eden Prairie. Sandvick seconded the motion. Krueger abstained. Motion carried. III. OTHER BUSINESS None IV. ADJOURNMENT MOTION: Sandvick moved, seconded by Krueger, to adjourn the meeting at 8:05 PM. Motion carried unanimously. I ill
