City Hall MEMBERS PRESENT: James Wedlund, Chairman, Ronald Krueger Richard Lynch and James Dickey MEMBERS ABSENT: Roger Sandvick STAFF PRESENT: Carl Jullie, P.E. Director of Public Works Sharon Gagnon, Recording Secretary CALL TO ORDER - ROLL CALL 1 . Minutes of August 21 , 1980, regular meeting. MOTION: Krueger moved, seconded by Wedlund, to approve the minutes of August 21 , 1980, regular meeting. Dickey abstained, motion carried. 2. Minutes of October 16, 1980, regular meeting. MOTION: Krueger moved, seconded by Dickey, to approve the minutes of the October 16, 1980, regular meeting. Lynch abstained, motion carried, • 3. Variance Request #80-41 submitted by Durabuilt for Harold Marquadt. The property is located at 16301 Valley View Rd. and the request is for a variance from the average front setback of the block to construct a garage. Present were Thomas Kasperzak Sr. and Jr. from Durabuilt and Harold Marquadt. Harold Marquadt told the Board of Appeals that he had a carport for- the past ten or more years and decided to build a double garage. Before starting the project, he called the Building Department and asked if he could build a garage where the existing carport stood. The Building Department came out to the house and said it was no problem. Durabuilt also went to the Building Department and received permission. Wedlund asked if he was using the present footings. Marquadt replied that full walls require different footings. He tore the carport down and Durabuilt removed the slab. Wedlund questioned the status of upgrading Valley View Rd. and the railroad bridge. Jullie replied that next summer a traffic signal will be installed at Valley View Rd. and County Rd. 4. Valley View Rd. will be widened to the east and then taper off. • Lynch questioned if this was a 2' variance request. Jullie stated that the average setback for this block is 50' and if approved, the front setback will be 28' . The proposed gqrage will be 19' to the Bd. of Appls & Adj -2- Dec. 18,1980 property line and the boulevard is 9 ft. • Wedlund noted that the carport is 2' larger (from 22' to 24' ). Krueger pointed out to the letters of approval from the neighbors. MOTION: Krueger moved to approve, seconded by Dickey, variance request #80-41 submitted by Harold Marquadt. The findings are the resident has removed a carport and will replace it with a garage in about the same location. with only a 2' difference. It is not harmful to the citizens of Eden Prairie. Motion carried unanimously. 4. Variance Request #80-42 cancelled. 5. Variance Request #80-43 thru 51 submitted by Countryside Investments, Inc. to allow a front setback of 25' rather than the required 30' . Present at this meeting was James Bast, 17440 West 66th St. Countryside Investments, Inc. was not represented. Lynch questioned why this was not sent back to the Planning Commission. Jullie said it was not a PUD, therefore, it could only be approved by the Board or the City Council . Bast said the sewer pipe installed in the street is 20' above the grade and wanted to know if this was correct. • Jullie replied positive and they would be compacting the added soil . Dickey asked Bast if he lived by the swamp. Bast replied positive. Lynch felt the lots should all be handled the same. Jullie said the company had trouble when they excavated for a basement. Bast said the water is still standing in the boring samples taken. MOTION: Dickey moved, Wedlund seconded, to continue variance request #80-43 thru 51 to the January 15th meeting and such people be notified. Motion carried unanimously. 6. Other Business. None. 7. ADJOURNMENT. MOTION: Krueger moved, Dickey seconded, to adjourn at 8:05. All in favor. •
