EDEN PRAIRIE ZONING BOARD OF APPEALS AND ADJUSTMENTS
THURSDAY, November 15, 1979 7:30 PM, CITY HALL

CALL TO ORDER - ROLL CALL
1 . Minutes of October 18, 1979 regular meeting.
MOTION: Cardinal moved, seconded by Sandvick, to approve the minutes
of October 18, 1979. Motion carried unanimously.
2. Variance Request #79-35 submitted by MTS Systems to allow construction
of a penthouse that would exceed the 40' maximum height in I-5 Park
District and the use of insulated wall panels.
Marshall Carpenter, representing MTS systems, was present since
Paul Strand was out of town.
Duane Miedlke from Ellerbe Assoc. explained that the unit to be built
in the penthouse would be for both the heating and the cooling. The
system is most economical utilizing the waste heat from the florescent
lighting and the heat created from the processing in manufacturing from
the building. The boilers and air handling are the two layers of
equipment. They will be adding 50,000 sq. ft. per floor with the
addition to the building. The penthouse will be 58' above the ground
using an insulated wall panel system that is needed because of the
weight load and the panels will be color harmonized with the building.
Wedlund questioned if this was the only reason for using the insulated
wall panels.
Miedlke explained that the other reason is that the panels are insulated
better with a much higher U factor than the pre-cast panels. He also
noted that there will be a door from the roof since the roof can be
reached by fire equipment and the penthouse will be sprinkled.
Lynch asked about the pay back from the energy savings from this unit.
• Miedlke said the initial investment is close to $100,000.00 more than
installing several small roof top units but will be paid back in 3-5 yrs.

Lynch questioned the need for the boiler and air handling equipment to be
located at the top of the building.
Miedlke said it was because of the duct work to be stacked.
Wedlund asked if this is the minimum height for the penthouse.
Miedlke answered that the mechanical engineer would like another couple
of feet but they have kept it to this minimum. He noted that in order
to see the penthouse you would have to be 250 - 300' from the site.
Wedlund questioned Jullie in regard to the proposed townhouses to the
southwest of the site.
Jullie said the townhouses were recently approved and will be east of
Mitchell and south of Scenic Heights. The townhouses will look out
on this project.
Wedlund questioned the individual in the chambers if she had an interest
in this project.
Malleree Thompson replied she was interested in the proceedings of this
project and approved of the energy conservation involved.
Sandvick questioned Jullie if he anticipated the City Council to revise
the ordinance because our fire department can handle different heights.
Jullie answered that the original intent was for fire protection but it
has not specifically been addressed to the City Council as yet and it
would probably be several months before it could be revised.
MOTION: Lynch moved to approve the variance request since the current
problems of Iran, deflating dollar, gasoline and the cost of energy
uncontrollable should encourage the commission to motivate this kind
of approach. Ordinances and rules should be in favor of these energy
saving methods. Industry will probably have to lead the way. Motion
seconded by Sandvick. Wedlund added that he agreed that the prime
concern is energy savings and noted that the unit will have a', self
contained sprinkling system. Mover and seconded agreed with the addition.
The vote on the motion with the addition passed unanimously.
3. Other Business.

4. Adjournment.

carried unanimously.
