MINUTES
EDEN PRAIRIE ZONING BOARD OF APPEALS AND ADJUSTMENTS
THURSDAY, August 16, 1979 7:30PM - CITY HALL
MEMBERS PRESENT: Chairman James Wedlund, James Cardinal

CALL TO ORDER - ROLL CALL
1 . Minutes of July 19, 1979 regular meeting.
This item will be continued to the Sept. 20, 1979 regular meeting.
2. Continued Variance Request #79-24 submitted by Praire State Bank __
requesting 2nd idenification sign on site having area in excess of
36 sq. ft. and height in excess of 8 ft.
• Jim Larson, Architectural Alliance, presented a revised sign approximately
45 sq. ft. The time and temperature on the original proposed sign would
be deleted on this sign. The construction would match the building
using stucco and bronze idenification letters. This sign would be
2 sided placed directly on the ground without a stand.
MOTION: Cardinal moved to grant the request because it is reasonable
and in good taste. There would be no consequence to the community.
Sandvick seconded, motion carried unanimously.
3. Variance Request #79-26 submitted by Eunice M. Green, 6611 Leesborouah Ave.
from the side yard setback of 30' .
Roger Sandvick explained that he would be abstaining from voting since
he is an immediate neighbor of Eunice Green.
Eunice Green told the Board she wished to build an addition to her
present garage using the same roof line and exterior and roofing materials
to match the house. She noted that her neighbors on Manchester do
not have the required 30' setback.
Sandvick questioned if she would be increasing a single garage to a
double garage.
Green explained that she had a double garage but would be adding another
for added storage space.

Jullie explained that the Ordinance requires a 30' side yard setback for a
a corner lot. He explained that 16' is the boulevard and owned by the City.
MOTION: Cardinal moved to grant the variance because it seems a reasonable
request with ample room. There were no complaints from the neighbors and
this addition would enhance the value of the property. This would not harm
the welfare of the community. Krueger seconded, motion carried with Sandvick
abstaining.
Wedlund added that this would not cause a traffic hazard to the area.
4. Variance Request #79-27 submitted by Edenvale Industrial Co. for property
located at 14705 Martin Drive, to allow joint driveway access and reduced
sideyard setback.
Kaye Schumacher from Edenvale explained that they had originally intended to
build two warehouses each the same with 31 ,000 sq. ft. After a soil boring
test showed 6' of unsuitable material and ground water, it was necessary to
change the positions of the buildings. They would like the second building
to have 26,000 sq. ft.
Wedlund questioned Jullie if this building would meet all the other requirements..
• Jullie was not certain but said the Board could specify that they do. He noted
that the building would have a zero lot line.
Kaye explained to the Board where the existing building was and where the
joint driveway access would be. The area with'bad soil would be the loading
area but they would remove part of the soil and add crushed limestone with
blacktop.
Wedlund questioned what the side yard setback should be for this area.
Jullie answered 20' .
Wedlund asked Schumacher how many sq. ft. of building space would be lost if
they had to have a 20' side yard setback.
Schumacher answered approximately 2000 sq. ft. less.
Wedlund felt that a shared driveway is a practical thing but questioned the
zero lot line. He noted that a written agreement with a reciprocal easement
for ingress and egress would be necessary for the two parties involved.
Mr. Don Peterson noted that his company was purchasing one of the buildings and
they had everything worked out in regard to the joint driveway and they had
no objection to the variance request.
• MOTION: Cardinal moved to approve the variance on the basis that this is a
special situation because of the soil conditions that dictate how the land is
used. To refuse the petition would not make any sense. There were no problems
with the neighboring properties. Thhis is granted under the condition that the
building conforms to all the other requirements. There is no adverse effect to

the health and welfare of the community. Sandvick seconded, motion carried
unanimously.
5. Variance Request #79-28 submitted by Dirlam Properties and Dolphin Construction
Co. for property located at 15050 Martin Drive to allow lot sizes of less than
2.0 acres, joint driveway access and parking space setback.
Present were Don Peterson, vice president of Dirlam properties, Dan Johnson
from Pioneer Builders and Kaye Schumacher who owns the property adjacent
to this parcel .
Don Peterson explained they had originally planned to build in the center
of the property but had three soil borings tests taken which indicated
peat from 23' - 32' . They built a car wash on the east side of the
property (parcel 1 ). They wish to split the property and build on Parcel 2
which Dave Schultz from Dolphin Construction and Dan Johnson from
Pioneer Builders expressed interest in. This would require a joint driveway
and two parking spaces which would not meet the set back requirements.
Wedlund questioned the need for parking spaces for the car wash.
Peterson answered that they had three wiping stalls.
Jullie noted that the Ordinance defines parking stalls as any temporary
storage of cars.
Wedlund questioned the lot size of less than 2.0 acres.
Peterson explained that the Council had already approved the subdivision
into 16,000 sq. ft. in I-2 Park.
Dan Johnson agreed to a joint driveway and this will be filed with the
deed. This is already on the survey.
MOTION: Wedlund moved to approve the petition since the City Council has
already approved the land division in the past. The property will be
subdivided as on the survey. Parcel 1 and 2 will have a joint driveway
which he felt was economical . The parking space setback would be granted.
This would not cause injury to the health and welfare to the citizens of
Eden Prairie. Cardinal seconded, adding that the soil conditions restrict
the use of this property. All in favor, motion carried.
6. Other Business.
Jim Beiswanger from Parker Hannifin Corp. explained they wanted to come
before the Board to get their opinion before applying for a formal
variance request for materials to be used for a building they will be
constructing in Shady Oak Industrial Park. This structure is 56,000 sq. ft.
• that would include 8,000 sq. ft. office space and the remaining as
warehouse.
John Thompson from Parker Hannifin Corp. told they use a particular
siding which is energy efficient with a .05 U factor. He explained they

have 95 plants which are designed and constructed by them using this
material .
Jullie explained that Ordinance 135 deals with building materials.
Cardinal noted that the community is negative of steel buildings and
pole barns because they dent and are not insulated. However, he felt
this was more substantial and an energy saver.
Krueger felt he would like to see this kind of building as long as it was
done properly. This would be better than concrete block.
Sandvick stated that this was a good U factor and this could be a
precedence over metal buildings.
Wedlund said he was familiar with this construction and felt it was .
a cheaper way to build. He was in favor of the company coming back.
Jullie questioned if these buildings could be painted.
Beiswanger answered that they had painted one of their buildings six years
• ago because a new dye lot came through which did not match the existing
building. This is still holding up. He also added that the original paint
colors do not fade. Beiswanger noted that the building has a fire
rating that is Factory Mutual accepted and is within the acceptable limits
for toxin fumes.

MOTION: Cardinal moved to adjourn at 9:20. Wedlund seconded, all if favor.
