HomeMy WebLinkAboutBoard of Adjustments and Appeals - 11/16/1978 APPROVED MINUTES EDEN PRAIRIE ZONING BOARD OF APPEALS AND ADJUSTMENTS THURSDAY, November 16, 1978 7:30PM, CITY HALL MEMBERS PRESENT: James Cardinal, Ronald Krueger and Richard Lynch MEMBERS ABSENT: Chairman James Wedlund and Roger Sandvick STAFF PRESENT: Carl Jullie, P.E. Director of Public Works Sharon Gagnon, Recording Secretary 1. Minutes of October 19, 1978 regular meeting. Cardinal ruled to continue the approval of the Minutes from the October 19, 1978 meeting for lack of quorum present from that meeting. 2. Variance Request #78-17 from Michael J. Axtman for sideyard setback variance at 8360 Hiawatha Ave. Micheal J. Axtman presented a letter of approval signed by five of his neighbors. He explained he wanted to add a garage to his existing garage with a sun room above it. This addition would end 4' from the property line. Cardinal stated Caroly Maiden, 8380 Hiawatha, the neighbor to the south of Axtman's proposed addition, had called him. She was in opposition to the structure since it would make the two homes too close together and she was concerned over the possible drainage problem. Cardinal noted that the Board is sensitive to the immediate neighbors feelings. Krueger added if this variance request was for a one story structure he may feel different. Lynch stated that the neighborhood is not a zero lot line area and there is not another situation like it in Eden Prairie. He was not in favor of a two story plan. Cardinal felt the request was well beyond the limits of the City Ordinance. MOTION: Lynch moved to deny the variance based on the objection of the immediate affected neighbor. Krueger seconded; motion carried unanimously. DISCUSSION: The board discussed the possibility of adding the garage to the front of the existing garage noting that a variance would also be needed for this. 3. Variance #78-18 from Four-flex Development Co. for rear yard setback variance to constuct a deck at 9500 thur 06 Clubhouse Rd. Andrew McGlynn spoke in behalf of Four-flex Development. He stated the building is presently under construction but the surveyor did not Minutes - Zoning Bd. of Appls. approved Thursday, Nov. 16, 1978 and Adjust. -t- allow for the deck to extend 10' . Cardinal questioned if the deck was in the original plans. McGlynn answered that they had altered the plans to get the building within the lot lines. He noted that only one footing would be too close to the rear lot line because of the way the building is situated. MOTION: Krueger moved to approve the variance to allow a 4.51variance since it would not be a detriment to the health and welfare of the City .of Eden Prairie. Lynch seconded; motion carried unanimously. Jullie noted that McGlynn shod apply for a building permit for the deck. 4. Other Business. None. 5. Adjourment. Cardinal moved to adjourn at 8:30. Lynch seconded; motion carried unanimously. •
