iEDEN PRAIRIE ZONING BOARD OF APPEALS AND ADJUSTMENTS

1. Minutes of October 20, 1977 regular meetine.
NOTION: Krueger moved to approve the Minutes of the October 20, 1977
regular meeting, seconded by Sandvick. Motion carried unanimously.
2. Variance Request #77 1 from BRW. Inc. for one (l) foot side yard setback
variance for new house at ,9825 Garrison Way.
Mr. James E. Boerhave, B.R.W. Inc., spoke to the proposed request, ex-
plaining that an inadvertent surveying error had been made at the proper-
ty, with the westerly wall of the foundation of the dwelling being con-
structed nine feet from the westerly property line instead of ten feet as
• required by City Ordinance. He further explained that after due considera-
tion of the problem and its effect on properties they own, they request a
variance for relief of the ordinance violation.
City Engineer Jullie spoke to the lack of notices being published or
mailed for this variance request, explaining that owners of all properties
within 500 feet have signed the enclosed statement, agreeing to the variance
request.
MOTIONS Krueger moved to approve the variance because of the following
findings: The insignificance of a one foot variance in this case, the
granting of the variance will not be detrimental to the public health,
safety or welfare, or materially injurious to the public or private pro-
perties or improvements in the vicinity.
Sandvick added: approval by neighboring property owners as indicated by
signed document enclosed. Sandvick seconded, the motion carried unanimously.
Cardinal requested the Staff to research prior recommendation of the
Board of Appeals that the Staff be empowered to grant more or less minor
variances that occur from time to time.

NOTIONS Krueger moved to adjourn the meeting at 8:00 PM, seconded by
Sandvick. Motion carried unanimously.
