ZONING BOARD OF APPEALS AND ADJUSTMENTS

The meeting was called to order by Vice-Chairman Lynch at 7335 PM.
I. MINUTES OF APRIL 21, REGULAR M WING
XDTIONs Krueger moved, seconded by Sandvick, to include the Memo of April 27,
1977 from City Mngi.neer, Carl Jullie, in the approval of the Minutes regarding
Energy Systems, Inc., and to approve the Minutes of April 21, 1977 as published.
Motion carried unanimously.

Jullie spoke to the continuance of this request because of non-notification
of neighboring lot owners, and that this action has been fulfilled with the
notification of ten lot owners. (See attached mailing list)
Lynch asked for Jullie's feelings on the request. Jullie responded that a
5 foot variance would be more desirable because of the opposition of some
residents to the north, and he felt that a 5 foot variancel�y�oould be a fair
compromise. He added that with this variance, there woul significant
damage to the trees, and would cause less disruption to the neighborhood.
Sandvick asked about the position of the house to the north. Jullie answered
that it was situated 30 .feet back,
Krueger asked whether there was water in the back of the lot. Jullie responded
that the lot slopes back, and there is no water at this time.
Sandvick inquired about any opposition received, and expressed approval of the
inclusion of the mailing list of residents notified regarding the Besting.
Jullie said they had received no comments whatsoever, and assuming that the
neighbors received the notice, there is no opposition.
Krueger suggested that when people ask for a variance, ask them to show
neighboring houses.
Sandvick, referring to Certificate of Survey diagram, questioned the 10 foot
• setback indicated on one side of the house. Jullie responded that the appli.cea*
would have to amend his plan to allow a 15 foot sideyard setback, but he didn't
feel that would be a problem.

MOTION: Krueger moved to accept the Staff recommendation of approval of a
5 foot variance with the following oonsiderationss Residents to the north
are opposed to a 10 foot variance; a 5 foot variance will be relatively un-
noticeable because of the curving of the street at this location; house to
the north has no windows on south side and houses across the street have
irregular orientations with respect to their lot lines; and proposed house
location with a 5 foot variance will fit topography of the lot reasonably
well, and will help to minimize the economic and ecological concerns expressed
by the applicant. Sandvick seconded, the motion carried unanimously
III. AMITIOMAL ITEM OF BU3
Jullis spoke to the-Jetter of May 11, 1977 received by the City Staff from
the Attorney representing the residents of the Cedar Crest Drive area,
informing the City that they plan to appeal the action of the Zoning Board
taken at the March 18, 1976 meeting concerning the division of the property
on which Mr. Hendrickson's house is situated. He said the Council will
hear this appeal on June 3.4. He said the old Ordinance allows one year to
appeal, and the new Ordinance only allows 15 days.

unanimously.
