MINUTES
EDEN PRAIRIE ZONING BOARD OF APPEALS AND ADJUSTMENTS
Thursday, August 18, 1977 7:30 PM, CITY HALL

1. Minutes of the regular meeting of July 21, 1977.
2, Minutes of the continued meetin„g_of July 28, 1977.
MOTION: Lynch moved to approve the Minutes of the regular meeting of
July 21, 1977 and of the continued meeting of July 28, 1977. Krueger
seconded, motion carried unanimously.
3. Variance request 977-4 from Warren Gerecke for from and side ward-set-=
backs. Variances to accomodate proposed addition of 22X24t garage at.
6622 Golden Ridge Dr.0
Mr. Warren Gerecke spoke to his request for a variance, in order to
add a 22 % 241 garage in front of the existing garage. He explained
that the lot slopes toward the back and is a walk-out type house with
no possibility of building to the rear. He continued that their plans
are to convert the present garage to a family room and kitchen. He
added that the house is 661 from the blacktop road, and with the addi-
tion of 24 ft., they would be 42 ft, away.
Wedlund asked if surrounding lots were built upon. Gerecke responded
affirmative, and that one neighbor is 1021 and the other neighbor is

Jullie spoke to the 25t total for side yard setback, and the require-
ment was 301.
Wedlund commented that two variances were needed, the 5t variance for
the side yard setback, and a 6t variance to comply with the average
existing front yard setbacks of 481. He noted that since neighbors
were not in attendance, and were notified, there was no opposition to
the variances.
Wedlund questioned whether there was any possibility of future develop-
ment or road extension. Jullie responded that there is none planned,
and added that it does not lend itself to any development.
NOTION% . Lynch moved that the Board approve this front yard variance
of 61 and side ,yard variance of 5t for the following reasons: the home

to the south is 102' and the home to the north is 88' away from this home;
this home sits on a rather unique lot, so it would be very difficult to re-
cognize the variance after construction because of the way it would be com-
pleted. Wedlund seconded.
AMENDHM: Wedlund requested the addition of the followingsThere seems to be
no opposition from the neighbors to the variance request; the contour of the
street is such that the granting of the varianceswill not destroy the aesthe-
tic value of the property or surrounding property; and granting the variances
will not be detrimental to the public health, safety or welfare, or materially
injurious to the public or private properties in the vicinity. Lynch accepted
the AMENDMENT. The motion carried unanimously.
Chairman Wedlund informed Mr. Gereeke of the one year time limit of exercising
the variances.
4. Variance Request #77-5 from Ronald Pe11ier for side yard setback variance for
ro sed addition to garage at 8218 Hiawatha Ave..
Wedlund noted that the neighbors had been notified and there were none present
who had interest in the request.
Mr. Ronald Peltier presented his request, explaining that the house is 31'
from the lot line and they are proposing to build a 10' addition to the garage.
• Wedlund inquired whether Lot no. 2 was vacant. Peltier responded that the lot
is owned by his wife's sister, who owns the corner lot also, and that she
has no plans to build there.
Wedlund expressed concern for the possibility of someone building on Lot 2
some time in the future, and would ask for 5' variance.
Director of Public Works Jullie explained that since the ownership of Lot 2
was within the family, a deed restriction could be set on Lot 2, if the appli-
cants were agreeable, to require a minimum 25' side yard setback for any future
home.
M0TIONs Krueger moved to approve the request for a variance from the required
10' side yard setback to a 5' setback, on the condition that Mr. Peltier can
satisfy the legal requirements with the City Attorney of a deed restriction
on Lot 2 to require a minimum 25' side yard setback for any future home on that
lot. Lynch seconded the motion.
AM:BDN T was requested by Lynch to add:The variance does not place undue strain
on the health, safety or welfare, or materially injurious to the public or pri-
vate properties in the vicinity. Krueger accepted the amendment. The motion
carried unanimously.
Wedlund explained that Peltier had one year to comply wit) the variance.
5. Variance Request #77-6 from Vernon Steppe for aids yard setback variance for
,proposed construction at 15813 North Lund Road.
• Mr. Vernon Steppe spoke to his request to build a 24' X 30' garage on the west
side and was requesting a 6' variance to allow a 9' setback.

Wedlund inquired whether any of the neighbors were opposed to the variance.
Steppe responded that the neighbors had received the letter and were not
opposed, speaking specifically to the one neighbor whose land was quite low.
Jullie, referring to the neighbor in question, commented that he had also spoken
to him, and they had looked at the lot line and discussed it. The neighbor was
glad to know that a garage would be built for storage purposes and for the dogs
owned by Steppe.
MOTION: Lynch moved to approve the variance request 77--6, of 6r to allow a
9t sideyard setback for the following reasons: it creates no hardship nor is
detrimental to the health, safety and welfare of the citizens of Eden Prairie;
apparently no objection from his surrounding neighbors, in fact there is favor
expressed towards the request by immediately involved neighbors; and it would
enhance the property value of Mr. Steppe and of other properties surrounding it.
Wedlund seconded, and the motion carried, with Krueger abstaining.
6. Discussion of Section 2. Subd. 2.6 of Ordinance 135 relating to parking of
trucks in I5 - Park Districts.
Jullie introduced Mr. Robert Eidsvold, representing Barrett Moving & Storage
Company. He explained that Eidsvold has been discussing with the Staff his
intention to come to the City with a building application for m office and
warehouse facility off of Washington Ave., north of Valley View Rd.. ThO pro-
perty is presently soned I-5, and under subdivision 2.6 of the Ordinance, the
reauirement in the industrial district says that any tracks that are used as
part of the business, if capacity exceeds 3/4 of a ton, cannot be stored out-
side. He continued that there will be a need to park several tracks out in
the yard, and it would have to be screened and meet all the other reauirements.
He said that in speaking to subd. 2.6, there would have to be a variance or the
property would have to be re-zoned to I-General, and the Staff would like to
have the thoughts of the Commission on this.
Mr. Eidsvold spoke to the preliminary sketch by Rauenhorst, of 11 acres, con•
sisting of office and warehouse space. He explained that it would be their
home office, and they intended on doing it right, because they area punka
relations company and want to sell themselves. They welpme suggestions by
Planning Director Putnam or others on screening and planting.
Wedlund asked how many trucks would be on the lot at one time, Eidsvold res-
ponded that basically, their fleet is from twenty to thirty trucks, with eight
to ten on our lot at one time. He added that the trucks varied in size.•
The possibility of re-zoning to I-General was discussed, with Jullie pointing
out that the rest of the properties were I-5.
Eidsvold said he did not feel that screening was a big problem, and sag ested
three foot evergreens planted on top of a berm, with more trees in the back.
Wedlund commented that they could not oppose the proper type of screening,
ibut would not approve if it were in a residential area. He asked whether
there was any possibility of homes being built nearby.

Lynch responded that the area west of Smetana Lakes,was considered for apart—
ments, but questioned whether they would ever be built. Jullie added that they
are considering Industrial zoning for that area.
Jul-lie asked whether it was the sense of the Board that Eidsvold come back
before the Board and request a variance. Krueger suggested Eidsvold bring in
a landscape plan, along with application submitted.
It was the consensus of the Board that the property remain I-51 and that Eidsvold
request a variance, with the landscape plan for proper screening drawn up and
presented at the September 15th meeting.
Eidsvold explained they had hoped to receive a permit by September lst, but was
agreeable to the September 15th meeting, since it would take ten days published
notice for a special meeting, and that would exceed the September 1 date.
