MINUTES
ZONING BOARD OF APPEALS AND ADJUSTMENTS
Thursday, December 16, 1976 7:30 P.M. City Hall

The meeting was called to order at 7:45 P.M. by Chairman Wedlund.
Board members agreed to continue consideration of the Minutes of November 18, 1976
to end of Agenda.
I. Request for variame by Mr. Bonnie J o

Chairman Wedlund spoke to the proposed request for variance and requested that
Mr. Rolshall present his request.
Rolshall spoke to previous request lk years ago, which he said was not pertinent
now, because they have had more experience in manufacturing and have better
identified their true needs in selling his product. He presented pictures of
his product and explained because the load would be 10 ft. wide when stripped
to its minimum, he needed an acceptable drive-warof at least 120 feet. He added
that his plan included six work stations of $150,000 to $180*000 and Ithat
the number of stations that he has is important. He said that his trucks can
be backed in and cart out the device. Rolshall said he had two other alterna-
tives, but they were unacceptable compiwdses. He continued that his options
at this point are to build here or lease property elsewhere, and that he had
leased 20,000 ft. at McGregor, but would like to move info the Twin City area.
Wedlund inquired as to what the zoning was on the property. Sanders responded
that it was I-2.
Sorensen questioned Rolshall on expansion plans to the rear when there was a
need for more work station. Rolshall responded that they were of the opinion
that this present plan would be about a three year projected need and beyond
that we will need more space. He explained that he would make that expansion
somewhere else, but this property is paid for and it is the one that he can
make the most use out of.

Sorensen asked whether in second alternative, if there were six rather than
seven work stations, wouldn't this free space for trucks. Rolshall answered
that the area is too narrow and is blocked by the work stations.
Wedlund inquired as to the length of time it would take to build the units.
Rolshall answered it takes each station six to eight months to build 1/3 of
a unit.
Cardinal asked whether he had explored the idea of building addition in the
back. Rolshall responded that to him it is not a possibility because he does not
desire it.
Meeting ordinance parking requirements was discussed, and the Board members felt
there would be difficulties encountered as far as adequate parking spaces.
Sorensen spoke to recent Planning Commission recommendation to the City Council
that area north of Highway 169 to Pappy Grill property be zoned industrial, with
city sponsored owner cooperative PUD concept. He said no action has been taken
yet, but he said it would be desirable in order to get started by February.
MOTIONs Sorensen moved that the Board find that
the proposal for request of variance according to the plans presented to us this
evening be denied for the following reasons: 1. That the ordinance prohibits
truck doors facing the street. 2. That the driveway would encroach on the side
yard. setback. 3. The building itself will encroach on the west side yard setback.
!+. Parking requirements of the ordinance cannot be made on the remaining property
because of configurations of the building. 5. As the site is but one acre in size
and is not I-2 industrial zoning, it is a non-conforming use, and the enlargement
of any structure on non-conforming use is prohibited by our ordinance. Therefore,
because of the five variances that would be required, the request should be denied.
Cardinal seconded, motion carried unanimously.
II. Request for variance by Mr. Harold J. Baker for 18 ft. on North side of his
imoposed hou a due to co tour of his land, The ro is locate
West 1 th St. and is zoned rural.
Chairman Wedlund spoke to the request and asked Mr. Buzz Boutelle, representing
the Bakers, to explain the case. Boutelle explained that the house is approxi-
mately 500 feet from the street and has ample rear yard.
Sorensen asked whether the Bakers had given any thought to some time in the
future when this property would come into residential use with lots not quite
so large.
Boutelle indicated that if the house were moved over, the Bakers would not be
able to make use of the sewer.
Sorensen was concerned with the side yard setbacks for rural property, because
he felt that in the future these properties are going to be used for less than
these five acres, and from a planning view this needs to be looked at.

After discussion on moving of the house, Boutelle indicated that the grade would
have to be changed to do this, and he was not sure this could be done. He felt
that the oak trees in back could be affected also.
Board members Questioned Mrs. Baker as to the last stand of trees on their proper-
ty. She responded that she thought there would be trees right up to their deck,
and the moving of the house would probably cause the loss of some of these trees.
Wedlund asked Mr. & Mrs. Robert Blunt, 6501 168th Ave. W., for any objections or
feelings. Mr. Blunt stated that they had received the notice in the mail and that
this was their reason for attending. He said they had no objections to the Bakers'
ply,
Sorensen asked whether they would object to more houses in the area if the zoning
were changed. Blunt answered negative.
MOTION: Cebulla moved that whereas this Board finds that the planners of this
piece of property have attempted to utilize this property to its best advantage by
placing it on the highest knoll of the property to assure adequate elevation for the
sewer, and whereas this would require a minimum amount of fill and would leave the
land in its least disturbed state from its natural state, and whereas it leaves
open the optimum possibility of future use of remaining land should it ever be re-
zoned, and whams the request does not seem to pose undue hardship to surrounding
land owners, and whereas granting the variance would not be detrimental to the
• public health, safety or welfare, or materially injurious to the public or private
properties or improvements in the vicinity, and whereas the granting of the variance
in this instance will not constitute a special privilege, and whereas the failure
to grant a variance leaves a spectrum of substantial loss of vegetation on this
site, therefore, I move that this 18 foot variance on the north side
yard setback be granted. Sorensen seconded, emotion carried unanimously.
III. Approval of Minutes of November 18. 1976 meeting
Pg. 1, para. 2, sent. 3, correct "fabircated" to"fabricated".

Cardinal moved to accept Minutes of November 18, 1976 as corrected. Wedlund
seconded. Cebulla abstained because of absence, and Sorensen abstained because
he did not complete the reading of the Minutes. Motion carried,
Sorensen moved to adjourn at 9:35 P.M. Cardinal seconded, motion carried.
