HomeMy WebLinkAboutResolution - 98-74 - Eighteen Screen Movie Theater - PUD Concept Review - 04/21/1998 EDEN PRAIRIE MALL TWENTY SCREEN MOVIE THEATER CITY OF EDEN PRAIRIE HENNEPIN COUNTY,MINNESOTA RESOLUTION NO. 98-74 A RESOLUTION APPROVING THE PLANNED UNIT DEVELOPMENT CONCEPT REVIEW OF EIGHTEEN SCREEN MOVIE THEATER FOR GENERAL GROWTH WHEREAS,the City of Eden Prairie has by virtue of City Code provided for the Planned Unit Development(PUD)Concept of certain areas located within the City; and, WHEREAS, the City Planning Commission did conduct a public hearing on the Eighteen Screen Movie Theater PUD Concept Amendment by General Growth and considered their request for approval for development(and waivers) and recommended approval of the requests to the City Council; and, WHEREAS,the City Council did consider the request on April 21, 1998; NOW,THEREFORE,BE IT RESOLVED by the City Council of Eden Prairie,Minnesota, as follows: 1. Eighteen Screen Movie Theater, being in Hennepin County, Minnesota, legally described as outlined in Exhibit A,is attached hereto and made a part hereof. 2. That the City Council does grant PUD Concept approval as outlined in the plans dated April 14, 1998. 3. That the PUD Concept meets the recommendations of the Planning Commission dated March 23, 1998. Uram, City Clerk Exhibit A Eighteen Screen Movie Theater PROPERTY DESCRIPTION (Per Chicago Title Insu:-ance Company Title Commitment No. C 2449983, effective date November 17, 1994) Parcel 1: , Lot 2, Block 1, EDEN PRAIRIE CENTER 8TH ADDITION, according to the recorded plat thereof, Hennepin Coun!y, Minnesota. Parcel 2: The non-exclusive easements, other than the easements to perform right of self-help (Section 4.6) and the easements to public authorities (Section 4.14), created and granted as appurtenances to the aforedescribed Parcel 1, all created, defined and limited by that certain Operating Agreement dated February 28, 1975, recorded March 5, 1975 and November 18, 1976 as Document Nos. 4130898 and 1198956 made by and among Homart Development Co., Sears, Roebuck and Co., and Adcor Realty Corporation, amended by Amended and Restated Operating Agreement dated December 1, 1994, filed , as Document No. 6374665(Abstract) and (Torrens), in, over, upon and under the Shopping Center Site as that term is defined in said Operating Agreement and shown on the Site Plan attached to said Agreement as Exhibit "B", and known as "Eden Prairie Center."
