MEMBERS PRESENT: Paul Choiniere, Tony Hirt, Don Sorenson, James Wedlund The meeting was reopened at the request of the City Council. Mr. Riesgraf was not present at the meeting of May 20, 1974. The minutes of the May 20, 1974 meeting were approved as read. Don Sorenson obstained from voting because he was not in attendance at the last meeting. Mr. Robert Riesgraf was asked to present his case and give his reasons for asking for a varience. His reasons were as follows: 1) He wanted a certain plan--otherwise he would not be interested in building. 2) He used the basement floor elevation (minimum) obtained from the Engineering Department. 3) 8 feet of fill would be required at the lowest corner. 4) More large trees would have to be removed if house were placed at regular front and side yard setbacks. 5) Moving back would be a hardship and he requested irregular set- backs in this block. The chairman asked if anyone else wished to speaks in favor of the varience. No one responded. The chairman asked if anyone wished to speak against the varience. Mr. Marvin Johnson asked about proposed sewer elevation along the entire street. Mr. Riesgraf said he agreed and appreciated the cooperation of the Engineering Department. Mr. Johnson said that as long as he had to hold to 50 feet he felt others should have to do the same. Mr. Tony Hirt said that the Council is the only one that can legislate overall changes in setback. Mr. Neil, property owner, said that the City Council said that they were not educated enough on the subject to make a decision and for this reason they referred it back to the Board of Appeals. He indicated a person did not know where they were being pushed back from one to another. Mr. Sorenson, as a member of the Planning Commission explained setbacks. Mr. Riesgraf explained his three possible choices after he did not attend the May 20 meeting. 1) Accept the determination of the Board of Appeals. 2) Ask for another hearing before the Board of Appeals. 3) Ask for a hearing before the City Council. MINUTES-BOARD OF APPEALS MEETING 2 June 17, 1974 - 7:00 p.m. OMr. Fred Purcell said that the next person may request a 20 foot setback. Mr. Neil said he would request a 35 foot setback and that he may also buy the lot next to the one which he presently owns. He has an option on the second lot at this time. Mr. Olson (resident) said that the lots are over 50% built. He does see merit in irregular setbacks in some cases, but would be unhappy to see a home at the 35 foot setback. Mr. Paul Choiniere asked if sanitary sewer was installed in the sheet. Mr. Wayne Sanders indicated that sewer was not installed. Mr. Hirt said that they would be setting a precedence if they voted in favor of this varience. Mr. Paul Choiniere made a motion to reaffirm the decision of May 20, 1974. Mr. Jim Wedlund seconded the motion. Those in favor to reaffirm the decision of May 20--all. Those opposed--none. Hearing was terminated and board continued the meeting on rules of procedure for the Board of Appeals. The rules of procedure were studied and will be • proposed at the next meeting. Mr. Don Sorenson made a motion to adjourn the meeting. The motion was sec- onded by Mr. Jim Wedlund. Wayne Sanders Secretary
