I. ROLL CALL/CALL MEETING TO ORDER
Chair Pidcock called the meeting to order at 7:00 p.m. All members were present. Staff
Sinell explained that the Board members are appointed by the City Council and if a
homeowner disagrees with the Board's decision, they may appeal to the County.
II. ORDER OF BUSINESS
A. Minutes
MOTION by Malam, seconded by Best to approve the April 14, 2004 Minutes of
the Board of Appeal and Equalization Meeting. Motion carried 5-0.

Peppin said that there is some landscaping that needs to be completed to bring the
house up to sellable status.

Sinell indicated that the value of the home last year was $485,000 and at that time
the repairs were not complete. Since the repairs were almost complete, Sinell
indicated that an increase of more than $15,000 would be appropriate.
O'Connor asked the homeowner what was the purchase price of the house.
Peppin said that it was $625,000.
Malam said he could support$515,000 because the stigma is not at 100%.
MOTION by Malam, seconded by Pidcock to reduce the EMV to $515,000.
Illstrup said that at$515,000 the home is valued at$110,000 less that what the
homeowner paid for the home and the work is almost complete.
Best said that he thought$515,000 was a defendable figure and possibly $500,000
would be a good figure.
Pidcock indicated that this was definitely a hardship case.
MOTION by Malam, seconded by O'Connor to amend the first motion and
reduce the EMV to $500,000. Motion carried 5-0.

Sinell reported that the property was located in Hidden Ponds and the home was
damaged by fire in 2002 and all repairs have been completed. Sinell reported that
the home is 25 years old and is similar to the homes in the area. Jody Carlson,
Appraiser,reports that the home is valued at$270,000.
Sicard indicated that her backyard was only 7 to 10 feet which is much smaller
compared to her neighbors' yards. She also indicated that one year ago the EMV
was $130,000 because the home was uninhabitable. Sicard said she does not have
the quality she had in her original house and that everything now is very cheap.
Sicard said that in 2002 the EMV was $211,000,in 2003 the EMV was $130,000
and in 2004 the EMV is $253,000. She did not understand how the 2004 EMV
could be so high.
Best said that there is a good market for two-story homes.

Pidcock indicated that the home is in a nice location.
Sicard reiterated that everything put in the house after the fire was inferior quality.
Sinell said that the appraisal is based upon what is presently in the home.
Pidcock asked if there was any odor of fire in the home.
Sicard said that she had water damage and has had her basement flooded with
water on two occasions.
Pidcock said that it is very difficult to find a two-story home in Eden Prairie and
they are in high demand.
Sicard said that she has no yard.
Pidcock asked if Sicard had the home on the market.
Sicard said that she had,but it was in the 80s.
Sinell indicated that he trusted Jody Carlson's (appraiser)judgment.
Best indicated that it is very difficult to find a two-story, four bedroom home in
Eden Prairie and he felt that$253,000 is less than what the home could be sold
for.
O'Connor indicated that the EMV should stay at$253,000.
Malam also thought that an EMV of$253,000 is fair for the home.
MOTION by Malam, seconded by Illstrup to sustain the value of the home at
$253,500. Motion carried 5-0.

Salenger said that his neighbor's home is 90% of the value of his home and the
neighbor has a pool. Salenger said that the market value of his home is higher
that the comparables. Salenger said that the comparables were built in 1984, 1991
and 1988. Comparable 1 is valued at $390,000, Comparable 2 is valued at
$396,000 and Comparable 3 is not even near his house.

Sinell indicated that staff has to look at homes that have been sold.
Salenger said that a real estate agent told him that his home would be valued at
$385,000.
Salenger said the appraiser chose to ignore his neighbor's market value compared
to his. Salenger said it his home is appraised higher than the homes around him
and he felt that his home should be compared to the homes in his neighborhood
and not outside the neighborhood.
Sinell reiterated that appraisers have to look at homes that have been sold. Sinell
also indicated that Salenger's property looks upon a wetland.
Salenger said he thought his home should be valued at$390,000 rather than
$428,000. Salenger said that there have been no updates to his home in eight
years.
O'Connor said that his home is a walkout which adds a lot of value to a home.
Salenger said he still did not understand why his property is so much more than
his neighbors' homes and that is his main concern.
O'Connor said that the task is still to judge whether his home could be sold for
$420,400. O'Connor added that by looking at the home, she would put in on the
market for approximately $400,000.
Salenger said he would put it on the market for $389,000.
Best said that he did not think $389,000 for that home would be enough and he is
comfortable with $420,000. Best indicated that it is the Board's charter to try to
determine if the market value is fair given all that is known about the market.
Best said that in his judgment the house is worth $420,000.
Salenger asked if it would satisfy the Board if he received an appraisal from and
independent appraiser.
Malam said it was the Board's job to determine what his property is worth on the
open market.
Pidcock told Salenger that he had an opportunity to contact the appraiser a couple
of weeks ago.
O'Connor said that the board members are all active real estate agents.

Sinell told the Board members that based on timing, a decision had to be reached
that evening and the homeowner had a right to appeal the decision at the County
level.
MOTION by Malam, seconded by Best to sustain the value of the property at
$420,400. Motion carried 5-0.
