HomeMy WebLinkAboutResolution - 97-212 - Vacation 97-02 Drainage & Utility Easement Menard 7th Addition - 11/18/1997 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 97-212 VACATION OF DRAINAGE AND UTILITY EASEMENTS OVER PART OF LOT 1, BLOCK 1 MENARD 7TH ADDITION WHEREAS, the City of Eden Prairie has certain drainage and utility easements described as follows: That part of the 30.00 foot wide drainage and utility easement over Lot 1, Block 1, Menard 7th Addition, Hennepin County, Minnesota, more particularly described as follows: Said easement lies 20.00 feet southwesterly of,and 10.00 feet northeasterly of the following described line: Commencing at the most southerly corner of said Lot 1; thence North 45 degrees 00 minutes 00 seconds West, assumed bearing, and along the southwesterly line of said Lot 1, a distance of 274.20 . feet; thence South 45 degrees 00 minutes 00 seconds West, a distance of 10.00 feet;thence North 45 degrees 00 minutes 00 seconds West, a distance of 51.00 feet; thence North 45 degrees 00 minutes 00 seconds East, a distance of 165.00 feet; thence North 45 degrees 00 minutes 00 seconds West, a distance of 10.00 feet to the point of beginning of the line to be described; thence continue North 45 degrees 00 minutes 00 seconds West, a distance of 295.00 feet and said line terminating. WHEREAS, a public hearing was held on November 18, 1997 after due notice was given to affected property owners and published in accordance with M.S.A. 412.851; WHEREAS, is has been determined that the said drainage and utility easements are not necessary and have no interest to the public, therefore should be vacated. NOW, THEREFORE, BE IT RESOLVED by the Eden Prairie City Council as follows: 1. Said drainage and utility easements as above described are hereby vacated. 2. The City Clerk shall prepare a notice of completion of proceedings in accordance with M.S.A. 412.851. ADOPTED by the Eden Prairie City Council on November 18, 1997. ATTEST: Jean L.
