The meeting was called to order by Chairman Miller.

The minutes of June 21, 1966 were read and approved as read.
The motion was then made by Anthony Hirt, seconded by Ralph Nesbitt to amend the
minutes of June 21, 1966 on ITEM 6-8-66Z to clarify the type of construction that
Northern States Power Company would use in construction of their transmission lines.
On the feeder lines from the Sub Station to the Glen Lake Circuit, they would use
single poles of the wood similar to the present service poles already in use.
These poles would be slightly taller and would carry the transmission line with the
local service lines beneath. On the line from Bloomington and Edina to the Sub
Station, these would be steel towers carrying the transmission lines.
The motion carried.
ITEM 7-2-66Z PUBLIC HEARINGS
1. Joe Semrad-Shidla property
The request is to rezone from RA and POC to Rl. The notes are in Hearing File
#15. Mr. Moorehouse and Mr. McDonald appeared with Mr. Semrad presenting the
case for the petitioners. No one appeared in opposition to the rezoning. Motion
was made by Alvin Picha, seconded by Dr. J. Wright to recommend rezoning from
RA 6 POC to R-1.
The motion carried.
2. Greg Redpath
Notes are in file #12.
Mr. Wood reported that the area may require a lift station to properly service
it with sewer and also problems that without sewer several of the lots proposed
would be unbuildable. It was recommended previously that the Park Board take a
look at this area. The Park Board has not reported back to the Zoning Board on
this matter. Therefore a motion was made by David Dale, seconded by Ralph Nesbitt
to 'continue the hearing until July 19, pending a receipt of a report from the
Park Board and a recommendation from them.
The motion carried.
3. Olson-Moorehouse property
Request to rezone from RC and RA to Ml. The notes are in hearing file #14.
Mr. McDonald and Mr. Moorehouse appeared for the petitioner. No one appeared
in opposition. There was much discussion as to the use of the area, etc. ,
Mr. Hawkes made a verbal report on the area on how he felt at this time.
This area was predominately residential and to put an M1 zoning into the middle
of it would not be in keeping with the context of holding the area residential.
He also felt that certain of the businesses along the area were marginal bus-
inesses which would disappear in time and that the entire area should be re-
moved from the commercial zone and changed to a residential zone. If the Board

felt that the commercial zone was needed, a commercial block somewhere in
the area should be designated so that it could properly be developed rather
then the stripped commercial.
A motion was then made by Ralph Nesbitt, seconded by Anthony Hirt to deny
the request for rezoning based on and agreeing with Jim Hawkes' verbal
statements. In seconding the motion, Anthony Hirt also wanted to add that
he did not feel like opening up a new M zone in the Village when we already
have over 2,000 acres of land in the M zoning.
By a roll call vote, Cecil Cruse voted yes, Albert Picha voted yes, Anthony
Hirt voted yes, A. W. Miller voted no, Ralph Nesbitt voted yes, Dr. J. Wright
voted no, David Dale voted yes.
The motion carried.
James Hawkes wanted to go on record that he feels there is a need in the
Village for an area to be set-up under an M1 zoning for this type of bus-
iness but that he did not feel that this area was particularly suitable for
an M1 zoning and that further study should be provided to properly locate this
type of area in the Village.
4. The Bren-Kusisto-Dvorak-Greguson-Wright request for rezoning from RA and RC
to C2. Hearing notes are in Hearing file #16.
Mr. Paul Greguson appeared before the Council representing the petitioners and
stated their position. Twelve people appeared in opposition to the rezoning
or questioning it. Mr. Hawkes stated that while the basic idea of commercial
zoning wouldj6a_*1be good in this particular area. He felt that there should
be a special commercial zoning setup similar to our special industrial zoning
i for the development of properties n a commercial nature in certain Inter-
change areas so that we would receive the high type commercial as well as the
high type industrial structures in areas of high visibility to people travel-
ing through Eden Prairie.
Motion was then made by Ralph Nesbitt, seconded by Cecil Cruse to recommend to
the Council that they authorize Mr. Hawkes to study this area and make a re-
port at the zoning meeting of August 2 and to continue the hearing until
August 2, 1966.
The motion carried.
ITEM 7-3-66Z REZONING
The Clerk reported that he had heard from Research Incorporated, and Char-Lynn
regarding the request to have them consider for rezoning from M2 to SI. Both of
these firms had appeared in the affirmative on this matter. In order to bring
everything under consideration under one possible ordinance change and publication,
the Clerk had arranged with the Attorney as to the area to be considered and the
terminology to be used in publication and it was felt upon recommendation of the
attorney that they include in a new hearing, areas already having been recommended
or considered in order to bring it all into one matter. The area for a new hearing
would be the area in Section one, east of 169, the present highway, the area north

of the north quarter of Section 12, and east of highway 169. This would include
all of the area previously petitioned and the additional areas which the Zoning
Board has asked to be considered or are under consideration for a hearing.
A motion was made by Albert Picha, seconded by Cecil Cruse to set the hearing
for July 19, 1966 on the rezoning of the northeast area. Dale abstained.
The motion carried.
ITEM 7-4-66Z WILLIS EVERT PLAT FOR SKY BLUE ADDITION which was a preliminary
plat presented to the Council for the sub-dividing of the acreage that Mr. Evert
lives on into four lots.
Motion was made by Ralph Nesbitt, seconded by Dr. J. Wright to accept the plan
for study. An engineering report was requested for the Zoning Board meeting of
July 19, 1966.
The motion carried.
ITFII 7-5-66Z JOE RUZIC REQUEST FOR SANITARY LAND FILL
rr. Ruzic appeared before the Planning and Zoning Commission requesting permission
to put in a Sanitary Land Fill on the property owned by Willard Anderson along
Highway 169. This is basically low land. He wanted to put in a Sanitary Land
Fill so he could build up the level of the land and develope the property. There
are many questions to be answered on this.
The motion was made by Ralph Nesbitt, seconded by Albert Picha to accept this re-
quest for study and the members of the Planning and Zoning Commission to take a
loot: at the property and some of the proposals made by Mr. Ruzic for potential
ordinances governing Sanitary Land Fill and other controls in it's operation.
The motion carried.
ITEM 3-5-66Z EDEN PRAIRIE INDUSTRIAL PARK-
IIr. Andrew Justus appeared before the Zoning Commission asking for approval on his
preliminary plat for Eden Prairie Industrial Park. Mr. Mood stated that the basic
problems which had been ironed out in -the area. The only request that he had was
that the road which services in the area go completely through from State highway 5
to County Road 4 and not have two Cul-de-sacs, one coming off State Highway 5 and
one coming off County Road 4. His reasons for this were that (1) it would give us
another access between County Road 4 and County Road 5 should anything happen at
the major Interchange of 4 and 5. (2) It would also provide ease of maintenance as
far as snow plowing and street repair for the Village personnel and (3) would pro-
vide a smoother flow of traffic through the area. Mr. Hawkes also felt that we
should not have two dead end roads but that we should go from 4 all the way through
to 5 someplace in the area.
The Zoning Commission then took another look at it and considered the possibility
of running a road from the Cul-de-sac coming in off State Highway 5, straight west
along the north edge of lot "D" of the Eden Prairie Industrial Park to County Road
4. This would open up additional area to be developed without spoiling lot "D" by
having a road cut through the middle of it.

Motion was made by Dr. J. Wright, seconded by Cecil Cruse to accept the prelim-
inary plat and rec ommend to the Council for approval providing Mir. Justus de-
dicates 30 feet on the north side of lot "D" for a public street and utility
easement and a utility easement and a utility easement on the west property line
of lot "D".
The motion carried.
ITEMS 7-6-66Z AEROHEAD INDUSTRIES,INCORPORATED represented by Bruce Hepp and
Warren Peterson
They appeared before the Planning and Zoning Commission with the idea of putting
a specialty gift shop and specialty ice cream-candy store on Highway 169 just south
of the present State Look Out Park. It is to be a Chatet-Swiss type building hand-
ling mainly European made merchandise or specialities in candies and ice creams
under their own receipes. As the area presently is zoned POC, it *.could require
rezoning and in order to do this they would have to petition for a rezoning. They
stated. that they would bring in a petition properly filled out and the fee paid.
Motion was then made by Dr. J. Wright, seconded by Ralph Nesbitt to set the hearing
for August 2, 1966 for rezoning to Cl.

ITEM 7-A-66Z M.E. JENSEN
Mr. Jensen appeared before the Planning and Zoning Commission with a request for
putting a mobile home on the Bill Pearson property which was the old Smetana
place to allow a couple to live in a mobile home and take care of his horses. He
is renting the barn and land area from Mr. Pearson for the use of his family for
keeping and training specialty show and riding horses and the caretakers of the
animals want to live in a mobile home as the present house is not liveable and
Mr. Jensen, in fact, has recommended to Mr. Pearson that it be torn down and the
hole filled as it is presently a health hazard.
A motion was made by Dr. J. Wright, seconded by Albert Picha to recommend to the
Council approval of the trailer permit on a yearly renewable basis as long as the
horses are there and he felt that the location of this trailer could not be object-
ionable to any one, as it would not be readily visible from any place except on the
road going into the property and also the removal of the old house on the property
would be of value to the Village.
The motion carried.
ITEM 6-11-66Z LOUIS SCHMIDT
Mr. Bren's report on the neighbors of Mr. Schmidt was presented to the Zoning
Commission. Mr. Bren had contacted all of the neighbors. He had no objection
from 10 of the neighbors, 1 of the neighbors objected, and 3 were not at home so
that they could not be contacted. Based on this information the Planning and
Zoning Commission felt that the neighborhood generally being devoted to animals,
an additional area where animals would be kept would not be objectionable in the
neighborhood.
Dr. J. Wright moved, seconded by Ralph Nesbitt to recommend to the Council granting
of a special permit to Mir. Schmidt and to charge a fee for this permit so that it
could be periodically inspected both as to the sanitary conditions and also
objectionable conditions other than sanitary.
The motion carried.

ITEM 7-B-66Z JOE RUZIC
Mr. Ruzic presented a preliminary plat to the Council for development along Shady
Oak Road.
Moved by Ralph Nesbitt, seconded by David Dale to accept this plat for study.
The motion carried.
