HomeMy WebLinkAboutResolution - 95-23 - Approval and Authorization of Peterson and Klein Purchase Agreement and Option Agreements - 02/07/1995 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 95-23 WHEREAS, Darril S. Peterson and Barbara J. Peterson, husband and wife; Alan Klein, Daniel Klein, and James Klein, as Trustees of the 1975 Revocable Trust of George Klein; and, Marcella Klein and Eugene Weber, as Trustees of the Revocable Trust of Marcella Klein, as amended by an. Amendment and Restatement of the Revocable Trust of Marcella Klein dated December 27, 1989, and as further amended by a First Amendment to Amendment and Restatement of Revocable Trust of Marcella Klein, dated February 1, 1990 (the "Sellers" ) , are willing to sell to the City of Eden Prairie ( "City" ) certain Property consisting of the Southwest Quarter of the Southwest Quarter of Section 30, Township 116 North, Range 22 West, that part of the Southeast Quarter of the Southwest Quarter of said Section 30, and that part of Government Lot 7, Section 31, Township 116 North, Range 22 West lying Northerly of the centerline of State Highway No. 169 and South and West of a certain line consisting of 68 .7567 acres, pursuant to the terms of a Purchase Agreement between Sellers and the City presented by Sellers to the City ( "Purchase Agreement" ) , and WHEREAS, said Sellers are willing to grant to City an option to purchase that part of the West Half of the Southwest Quarter of the Southeast Quarter of Section 30, Township 116 North, Range 22 West, lying northerly of the centerline of State Highway No. 169 and South and East of a certain line consisting of 15 .8598 acres pursuant to an option agreement presented by Sellers to the City ( "Option Agreement Option Parcel 111 ) , and WHEREAS, said Sellers are willing to grant to City an option to purchase that part of the Southeast Quarter of the Southwest Quarter of Section 30, Township 116 North, Range 22 West, and that part of Government Lot 7, Section 31, Township 116 North, Range 22 West lying northerly of the centerline of State Highway No. 169, and East of a certain line and South of a certain line, consisting of 30 .2890 acres pursuant to an option agreement presented by Sellers to City ( "Option Agreement Option Parcel 2" ) . NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE: 1 . That the execution by the Mayor and Manager of the City on behalf of the City and delivery to Sellers of the Purchase Agreement, Option Agreement Option Parcel 1, and Option Agreement Option Parcel 2, is authorized and approved.
